The Shoreland Ordinance was adopted in 1992, prior to your purchase of the home, and <br /> therefore the conditions were in place. <br /> 5. The warranty deed attached to your homestead from within the City's street file (a copy has <br /> been included)indicates you have an easement for a"private sewer system including septic <br /> tanks and drainfield." In no way could the City interpret this to give you hardcover credit for <br /> Lot 31. <br /> 6. There are no provisions within the Shoreland Ordinance that would a11ow the treahnent of <br /> your lot as a"corner" lot with regards to the lakeshore setback. <br /> I have also reviewed this with the City Attomey,regarding the use of the easement for private storm <br /> sewer purposes. He concurs with Staff that the easement is for sanitary sewer purposes only. As I <br /> staxed during the meeting,it is doubtful that any proposal to increase the footprint of the structure <br /> on this property could receive a Staff recommendaxion of approval, based on e�cisting codes and <br /> regulations.
