Exhibit B <br /> PRACTICAL DIFFICULTIES DOCUMENTATION FORM <br /> LA21-000033 . <br /> 1. The property owner proposes to use the property in a reasonable manner not <br /> permitted by the Zoning Chapter. <br /> Response: Substandard lot size would be afforded the 30% lot allotment had the original builder <br /> applied for the variance which is the commonly approved variance for lots like this. <br /> We are requesting the variance in order to expand the deck to accommodate the homeowners <br /> growing family. <br /> 2. The plight of the landowner is due to circumstances unique to his property not created <br /> by the landowner. <br /> Response: The original builders opted to not apply for the variance for the substandard lot size to <br /> allow the hardcover coverage of 30% in the Tier 2 lot coverage size. Had they applied for the <br /> variance, we would not be needing to apply for the variance now. <br /> 3. The variance, if granted, will not alter the essential character of the locality. <br /> Response: The granting of the variance will not alter the character of the locality. It will simply allow <br /> the homeowners to increase their existing deck size and the lot coverage will increase by less than <br /> 3%. <br /> 4. Economic considerations alone do not constitute practical difficulties if reasonable use <br /> for the property exists under the terms of the Zoning Chapter. <br /> Response: Expanding the deck to 10' x 10' is a reasonable use of the property and a reasonable <br /> request to allow the homeowners to use the 30% hardcover of their property as would be allowed by <br /> the council should the variance by granted. <br /> 5. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br /> for solar energy systems. Variances shall be granted for earth-sheltered construction as <br /> defined in Minnesota Statutes, Section 1163.06, Subd. 2, when in harmony with this <br /> Chapter. <br /> Response: N/A <br /> 6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br /> use that is not allowed under this Chapter for property in the zone where the affected <br /> person's land is located. <br /> Response: The variance application and request is not unreasonable and is a standard request that <br /> is approved by the council and is allowed. <br /> 7. The Board or Council may permit as a variance the temporary use of a one-family <br /> dwelling as a two-family dwelling. • <br /> Response: N/A <br /> 8. The special conditions applying to the structure or land in question are peculiar to such <br />
