The conditions do not apply generally to other land or structures in the district <br /> in which said land is located. <br /> Response: The owners do not believe the quoted practical difficulty is applicable <br /> to their variance application. <br /> 10. The granting of the application is necessary for the preservation and <br /> enjoyment of a substantial property right of the applicant. <br /> Response: The owners, having lived in and on the property for going on 29 years, <br /> and, having made major and substantial financial improvements to the property <br /> over the years including to the outside grounds, a new well, landscaping timbers, <br /> gardens, shoreline improvements, various trees removed on the lakeside and other <br /> parts of the property, inside improvements to the upper level including a new <br /> kitchen and cabinetry, new hardwood floors, new windows, a new patio door to the <br /> existing deck, lower level improvements including drainage systems, carpeting, <br /> new laundry room, new well room, tiling and various other lower level <br /> improvements including new lower level kitchen appliances. In recent years, the <br /> owners have found that substantial maintenance of the existing deck (which they <br /> have done several times over the years) has become a burden physically and <br /> financially and not worth the time or money to do so at this stage of their lives. <br /> Therefore the decision to design and build the new proposed deck only slightly <br /> and modestly larger than the existing deck which is badly in need of either <br /> substantial repairs and maintenance, and/or replacement, was a rather easy <br /> decision to replace. Another factor in arriving at the decision to replace the <br /> existing deck with a new and yet modestly larger deck has been the owners' ability <br /> to finance the construction of the new deck as well as other improvements under <br /> consideration as a result of the recent refinancing of their mortgage loan on the <br /> property allowing them to free-up some of the equity and capital appreciation in <br /> their property over their years of ownership. <br /> 11. The granting of the proposed variance will not in any way impair health, safety, <br /> comfort, morals, or in any other respect be contrary to the intent of the Zoning <br /> Code. <br /> Response: The owners believe this statement to be true in all respects. <br />
