<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A PRELIMINARY PLAT FOR <br />ORCHARD HILL (FILE NO. LA20-000030) AND <br />A COMPREHENSIVE PLAN AMENDMENT #3 <br />TO EXPAND THE METROPOLITAIN URBAN SERVICE <br />AREA (FILE NO. LA20-000050) <br /> <br /> <br />WHEREAS, on April 22, 2020 Eric Luth, o/b/b YMCA of the Greater Twin Cities <br />and Gordon James, LLC (“Applicant[s]”), applied for a preliminary plat for the property legally <br />described in Exhibit A, (hereinafter the “Property”); <br /> <br />WHEREAS, on July 22, 2020 Eric Luth, o/b/o Harry Schleetar and Gordon James, <br />LLC (“Applicant[s]”), applied for a Comprehensive Plan Amendment (CPA) for the property legally <br />described in Exhibit A, (hereinafter the “Property”); <br /> <br />WHEREAS, on May 18, 2020, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning the preliminary plat application were given the <br />opportunity to speak thereon; and <br /> <br />WHEREAS, on August 17, 2020, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning the revised preliminary plat and CPA <br />application were given the opportunity to speak thereon; and <br /> <br />WHEREAS, on August 17, 2020, the Planning Commission recommended <br />approval of the preliminary plat and CPA; and <br /> <br />WHEREAS, on September 14, 2020, the City Council reviewed the application <br />and the recommendations of the Planning Commission and City staff; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br />Minnesota hereby approves the requested preliminary plat as described above based on one or <br />more of the following findings of fact concerning the Property: <br />
