When a proposed drainage system will carry water across private land outside the 1536 <br />subdivisionplat, appropriate drainage rights must be secured and indicated on the plan if the 1537 <br />subdivision is a plat. 1538 <br />c. The subdivider shall dedicate, by drainage or conservation easement of land on both sides of 1539 <br />existing watercourses, to a distance to be determined by the city. 1540 <br />d. Wetlands, swamps and low-lying lands along watercourses subject to flooding or 1541 <br />overflowing during storm periods, whether or not included in areas for dedication, shall be 1542 <br />preserved and retained in their natural state as drainageways; and conservation and flowage 1543 <br />easements for those areas shall be dedicated to the city. Such lands subject to periodic 1544 <br />flooding shall not be computed in determining the number of lots to be utilized for average 1545 <br />density procedure nor for computing the area requirements of any lot. 1546 <br />Sec. 82-223. - Water facilities. 1547 <br />(a) Public water systems. 1548 <br />(1) Where a public water main is accessible, the subdivider shall install adequate water facilities, 1549 <br />including fire hydrants, subject to the specifications of the stateState or city. 1550 <br />(2) Water main extensions shall be approved by the city. 1551 <br />(3) To facilitate the provisions of subsections (a)(1) and (2) of this section, the location of all fire 1552 <br />hydrants and all water supply improvements and all improvements proposed to be served shall be 1553 <br />shown on the preliminary subdivisionplat, and the cost of installing such improvements shall be 1554 <br />included in the performance bondBond to be furnished by the subdivider. 1555 <br />(b) Individual wells. 1556 <br />(1) In the discretion of the city, if a public water system is not available, individual wells may be 1557 <br />used. Water samples shall be submitted to the stateState health department for its approval. 1558 <br />(2) If the city requires that a connection to a public water main be eventually provided as a condition 1559 <br />to approval of an individual well, the subdivider shall make arrangements for future water service 1560 <br />at the time the subdivisionplat receives final approval. 1561 <br />Sec. 82-224. - Sewerage facilities. 1562 <br />(a) General requirements. Where public sanitary sewer is available, the subdivider shall install sanitary 1563 <br />sewer facilities in a manner prescribed by the city's construction standards, specifications and 1564 <br />provisions of this Code. All plans shall be designed in accordance with the rules, regulations and 1565 <br />standards of the city, stateState health department, and other appropriate agencies. Plans shall be 1566 <br />approved by these agencies. 1567 <br />(b) Connection. Where a public sanitary sewerage system is reasonably accessible, the applicant shall 1568 <br />connect the system and provide sewers accessible to each lot in the subdivisionplat. 1569 <br />(c) Central system. In the Metropolitan Urban Service Area (MUSA), wWhere public sanitary sewerage 1570 <br />systems are not reasonably accessible but will become available within a reasonable time (not to 1571 <br />exceed 15 years), the applicant may choose a central sewerage system. The maintenance cost shall be 1572 <br />assessed against each property benefited. Where plans for future public sanitary sewerage systems 1573 <br />exist, the applicant shall install the sewer lines, laterals and mains to be in permanent conformance 1574 <br />with such plans and ready for connection to such public sewer mains. 1575 <br />(d) Septic system. In the MUSA, and Wwhere sanitary sewerage systems are not reasonably accessible 1576 <br />and will not become available for a period in excess of 15 years, the applicant may install a sewerage 1577 <br />system in accordance with chapter 58, article II. 1578 <br />(e) Design criteria for sanitary sewers. 1579 <br />Commented [JB98]: We already define lot area.
