July 20, 2020 page 22 <br />other government agencies or jurisdictions for their review and action as may be appropriate prior to 899 <br />council action on the final plat. 900 <br />Sec. 82-117. - Effective period of preliminary subdivisionplat review. 901 <br />Planning commission recommendations concerning any class I subdivision and the Ccouncil 902 <br />resolution concerning any class II and class III preliminary plat shall remain effective for one year. 903 <br />Failure to file a complete final subdivisionplat application within this time period shall be construed as 904 <br />formal withdrawal of the proposed subdivisionplat. 905 <br />For one year following preliminary approval, unless the subdivider and the city agree otherwise, no 906 <br />amendment to a comprehensive plan or official control shall apply to or affect the use, development 907 <br />density, lot size, lot layout, or dedication or platting required or permitted by the approved application. 908 <br />Thereafter, pursuant to its regulations, the city may extend the approval period by agreement with the 909 <br />subdivider and subject to all applicable performance conditions and requirements, or it may require 910 <br />submission of a new application. In no case shall the approval period be extended greater than three years. 911 <br />Secs. 82-118—82-140. - Reserved. 912 <br /> 913 <br />DIVISION 3. - FINAL SUBDIVISIONS PLATS 914 <br /> 915 <br />Sec. 82-141. - Generally. 916 <br />(a) Purpose. Final subdivisionplat review is the final third stage of the subdivisionplat review process. 917 <br />The legal documents, including subdivisionplat drawings, are reviewed for completeness and 918 <br />conformity with the intent and requirements of the preliminary plat approval. 919 <br />(b) Requirements. The subdivider applicant is required to furnish completed surveying, engineering, and 920 <br />legal documents suitable for recording in the county recorder's office, incorporating all the information 921 <br />and/or changes required as part of the preliminary subdivisionplat review and resolution of preliminary 922 <br />subdivisionplat approval. All documents and requirements shall be completed by the subdivider, 923 <br />reviewed by the city staff and the council, and approved by the council prior to the mayor's and city 924 <br />clerk's certifying approval of the final subdivisionplat. 925 <br /> 926 <br />(c) Prerequisite. A preliminary subdivisionplat of substantially the same proposal shall have been 927 <br />approved by the council within one year of the filing of any final subdivisionplat application. The 928 <br />zoning administrator City Administrator or designee shall review each final subdivisionplat 929 <br />application to ensure substantial conformity to the requirements and representations on the preliminary 930 <br />subdivisionplat. 931 <br />(d) Substantial change from preliminary subdivisionplat. The zoning administrator may refuse to accept 932 <br />for filing and/or the council may refuse to review approve any final subdivision plat application which 933 <br />is substantially different from the approved preliminary subdivisionplat, or which discloses possible 934 <br />misrepresentations on the preliminary subdivisionplat. In the case of such deniala refusal, the zoning 935 <br />administrator or council may require the applicant subdivider to resubmit the proposal for planning 936 <br />commission reconsideration, and may require the subdivider applicant to submit or resubmit any and 937 <br />all documents or information required for preliminary subdivisionplat review. Planning commission 938 <br />reconsideration may include a new public hearing if so required by the planning commission or zoning 939 <br />administrator. The subdivider applicant shall pay applicable fee equal to half the applicable 940 <br />preliminary subdivisionplat review fees for required reconsideration of any proposal occurring within 941 <br />one year of the original preliminary subdivision approval date. 942 <br />Sec. 82-142. - Final subdivisionplat application. 943 <br />(a) All subdivisionplats.
