Payment of the sketch plan review fee. 640 <br /> (2) Application deadlines. The subdivider shall file a complete sketch plan application with the 641 <br />zoning administrator 21 days before the meeting of the planning commission at which the sketch 642 <br />plan application will be reviewed. The zoning administrator shall advise the subdivider of the 643 <br />current schedule of meetings of the planning commission. 644 <br />(d) Sketch plan review and recommendations. 645 <br />(1) Recommendations to the subdivider. After reviewing and discussing the sketch plan, City 646 <br />Administrator or designee will advise in a general manner the subdivider of the changes or 647 <br />additions, if any, which will be required in the layout, and the character and extent of required 648 <br />improvements and dedications which will be required as a prerequisite to the approval of the final 649 <br />plat. 650 <br />(2) Sketch plan review. The planning commission shall study the sketch plan, taking into 651 <br />consideration the requirements of this chapter and the best use of the land being subdivided. 652 <br />Particular attention will be given to the location, arrangement, shape and size of lots, access, 653 <br />parkland dedication, the further development of adjoining lands as yet unsubdivided, and the 654 <br />requirements of chapter 78 and the comprehensive municipal planCommunity Management Plan. 655 <br />(2) Recommendations to the subdivider. After reviewing and discussing the sketch plan, the 656 <br />planning commission and/or zoning administrator will advise in a general manner the subdivider 657 <br />of the changes or additions, if any, which will be required in the layout, and the character and 658 <br />extent of required improvements and dedications which will be required as a prerequisite to the 659 <br />approval of the preliminary plat. The planning commission may require additional changes as a 660 <br />result of further study of the preliminary subdivision. 661 <br />(3) The applicant may request review by the City Council. Upon such request, the Planning 662 <br />Commission’s comments shall be forwarded to the City Council for study and comment. 663 <br />[Reserved.] 664 <br />(4) Effective period of sketch plan review. Planning commission recommendations concerning any 665 <br />sketch plan shall remain effective for 90 days after the date of planning commission review. 666 <br />Failure to file a complete preliminary subdivision application within this time period shall be 667 <br />construed as formal withdrawal of the proposed subdivision. Renewal of any proposed 668 <br />subdivision after this deadline shall require a new sketch plan application, including application 669 <br />form, material submittals and fee payments. 670 <br />Sec. 82-86. - Vested rights. 671 <br />No vested rights shall accrue to any subdivision by reason of preliminary or final subdivision 672 <br />approval except as stated in this article. For one year following preliminary approval and for two years 673 <br />following final approval, unless the subdivider and the city agree otherwise, no amendment to a 674 <br />comprehensive plan or official control shall apply to or affect the use, development density, lot size, lot 675 <br />layout, or dedication or platting required or permitted by the approved application. Thereafter, pursuant to 676 <br />its regulations, the city may extend the period by agreement with the subdivider and subject to all 677 <br />applicable performance conditions and requirements, or it may require submission of a new application 678 <br />unless substantial physical activity and investment has occurred in reasonable reliance on the approved 679 <br />application, and the subdivider will suffer substantial financial damage as a consequence of a requirement 680 <br />to submit a new application. In connection with a subdivision involving planned and staged development, 681 <br />the city may by resolution or agreement grant the rights referred to in this section for such period of time 682 <br />longer than two years which it determines to be reasonable and appropriate. 683
