public assistance, disability or any other type of harassment or discrimination <br />prohibited by law and City Policy. <br />g. To engage in any type of commercial enterprise unrelated to the specific purposes <br />and needs of the City. <br />h. To engage in any form of solicitation without the express prior written consent of <br />the Department Director or City Administrator. <br />i. To promote any political or private causes, or other activities, without the express <br />prior written consent of the Department Director or City Administrator. <br />j. To enter into financial or contractual obligations without the express prior written <br />consent of the Department Director or City Administrator. Any financial or <br />contractual obligation entered into by an employee without the express written <br />consent of the Department Director or City Administrator shall be the sole <br />responsibility of the employee. <br />k. To advocate any type of unlawful violence, vandalism, or illegal activity. <br /> <br /> Safety: Cell Phone Use While Driving <br /> For safety reasons, use of a cell phone while driving a motor vehicle or operating highway <br />equipment should be kept to a minimum. Employees should pull off the road or use a hands-free <br />device to conduct business using a cell phone. In all cases, employees shall follow local and State <br />regulations regarding the use of cell phones while operating a motor vehicle. <br /> <br /> It is a violation of state law for drivers to hold a cellphone or other communication device <br />in their hand while operating a vehicle. Drivers may not view videos, play games, or access a <br />webpage while operating a vehicle. This law applies to all electric communication devices. <br />Drivers utilizing hands free technologies are encouraged to pull off the road when using a cell <br />phone. Employees are responsible for fines and fees if found violating state or federal laws. <br /> <br /> Privacy <br /> Designated employees are provided City-owned cell phones to assist them in the <br />performance of their jobs. All such equipment is the property of the City and is to be used for City <br />purposes. Employees with City-owned cell phones should have no expectation of privacy in <br />anything they create, store, send or receive using the City’s cell phone. <br /> <br /> Information created, stored, sent, or received by an employee acting in his or her <br />government capacity using a personal cell phone may be classified as government data subject to <br />the requirements of the Minnesota Government Data Practices Act. Such data is subject to review <br />by the City and disclosure to the public where required by law. <br /> <br /> Responsibility <br /> The City Administrator, or designee, will have primary responsibility for implementation <br />and coordination of this policy. Violations of this policy will subject the user to disciplinary action <br />in accordance with the personnel policy or collective bargaining agreement. The Division <br />Directors will be responsible for enforcement within their departments. When an employee <br />terminates employment, the Division Director is responsible to ensure that a City-owned cell <br />phone is returned to the City. The City-owned cell phone shall be returned to the City prior to <br />final compensation to the employee.
