July 20, 2020 page 24 <br />connection shall be incorporated by inclusion in the performance Bond required for the final 994 <br />subdivision. 995 <br />(3) Accommodation of upstream drainage areas. A culvert or other drainage facility shall in each 996 <br />case be large enough to accommodate potential runoff from its entire upstream drainage area, 997 <br />whether inside or outside the subdivision. The city shall determine the necessary size of the 998 <br />facility, based on the provisions of the construction standards and specifications assuming 999 <br />conditions of maximum potential watershed development permitted by chapter 78 and 1000 <br />Community Management Plan. 1001 <br />(4) Effect on downstream drainage areas. The city shall also study the effect of each plat on existing 1002 <br />downstream drainage facilities outside the area of the plat. City drainage studies, together with 1003 <br />such other studies as shall be appropriate, shall serve as a guide to needed improvements. Where 1004 <br />it is anticipated that the additional runoff incident to the development of the plat will overload an 1005 <br />existing downstream drainage facility, the city may withhold approval of the plat until provision 1006 <br />has been made for the improvement of the potential condition at the subdivider's expense and in 1007 <br />such sum as the city shall determine. No plat shall be approved unless adequate drainage will be 1008 <br />provided to an adequate drainage watercourse or facility. 1009 <br />(5) Floodplain areas. The city may, when it deems it necessary for the health, safety or welfare of 1010 <br />the population of the area and necessary to the conservation of water, drainage and sanitary 1011 <br />facilities, prohibit the subdivision of any portion of the property which lies within the floodplain 1012 <br />of any stream, lake or drainage course. These floodplain areas shall be preserved from any and 1013 <br />all destruction or damage resulting from clearing, grading or dumping of earth, waste material or 1014 <br />stumps by the appropriate conservation easement. 1015 <br />(c) Dedication of drainage easements. 1016 <br />(1) General requirements. Where a plat is traversed by a wetlands, swamp, watercourse, 1017 <br />drainageway, channel or stream, there shall be provided a stormwater easement, conservation and 1018 <br />flowage easement, or drainage right-of-way conforming substantially to the lines of such 1019 <br />watercourse, and of such width and construction or both as will be adequate for the purpose. 1020 <br />Wherever possible, it is desirable that the drainage be maintained by an open channel with 1021 <br />landscaped banks and adequate width for maximum potential volume of flow. 1022 <br />(2) Drainage easements. 1023 <br />a. Where topography or other conditions are such as to make impractical the inclusion of 1024 <br />drainage facilities within road rights-of-way, perpetual unobstructed easements of an 1025 <br />appropriate width for such drainage facilities shall be provided across property outside the 1026 <br />road lines and with satisfactory access to a public roadway. Easements shall be indicated on 1027 <br />the plat. Drainage easements shall be carried from the road to a natural watercourse or to 1028 <br />other drainage facilities. 1029 <br />b. When a proposed drainage system will carry water across private land outside the plat, 1030 <br />appropriate drainage rights must be secured and indicated. 1031 <br />c. The subdivider shall dedicate, by drainage or conservation easement of land on both sides of 1032 <br />existing watercourses, to a distance to be determined by the city. 1033 <br />Sec. 82-223. - Water facilities. 1034 <br />(a) Public water systems. 1035 <br />(1) Where a public water main is accessible, the subdivider shall install adequate water facilities, 1036 <br />including fire hydrants, subject to the specifications of the State or city. 1037 <br />(2) Water main extensions shall be approved by the city. 1038
