July 20, 2020 page 23 <br />(b) Whenever it is deemed necessary by the city to defer the construction of any public or private 949 <br />improvements required in this section because of incompatible grades, future planning, inadequate or 950 <br />lack of connecting public or private improvements, or for other reasons, the subdivider shall pay their 951 <br />estimated share of the cost of the future improvements to the city prior to the signing of the final plat; 952 <br />or the subdivider may post a security insuring completion of such improvements upon demand of the 953 <br />city. 954 <br />Sec. 82-218. - Subdivisions straddling municipal and school district boundaries. 955 <br />Lot lines shall be laid out so as not to cross municipal and school district boundary lines. 956 <br />Sec. 82-219. - Monuments. 957 <br />The applicant shall place permanent reference monuments in the plat as required by statute. 958 <br />Sec. 82-220. - Character of the land. 959 <br />Land which the council finds to be unsuitable for subdivision or development due to flooding, 960 <br />improper drainage, steep slopes, soil conditions, rock formations, adverse earth formations or topography, 961 <br />utility easements, or other features which will reasonably be harmful to the safety, health and general 962 <br />welfare of the present or future inhabitants of the plat and/or its surrounding areas shall not be subdivided 963 <br />or developed unless adequate methods are formulated by the developer and approved by the council, upon 964 <br />recommendation of the city engineer, to solve the problems created by the unsuitable land conditions. 965 <br />Such land shall be set aside for uses as shall not involve such a danger. 966 <br />Sec. 82-221. - Plat name. 967 <br />The proposed name of the plat shall not duplicate, or too closely approximate phonetically, the name 968 <br />of any other plat in the city covered by this chapter. The council shall have final authority to designate the 969 <br />name of the plat, which shall be determined at preliminary plat approval. 970 <br />Sec. 82-222. - Drainage and storm sewers. 971 <br />(a) General requirements. The city shall not approve any plat which does not make adequate provision 972 <br />for stormwater or floodwater runoff. Surface water drainage patterns shall be shown for each lot and 973 <br />block. The stormwater drainage system shall be separate and independent of any sanitary sewer 974 <br />system. Storm sewers, where required, shall be designed by the method as approved by the city, and a 975 <br />copy of design computations shall be submitted along with plans. Inlets shall be provided so that 976 <br />surface water is not carried across or around any intersection, nor for a distance of more than 600 feet 977 <br />in the gutter in urban areas. When calculations indicate that curb capacities are exceeded at a point, no 978 <br />further allowance shall be made for flow beyond that point; and basins shall be used to intercept flow 979 <br />at that point. 980 <br />(b) Nature of stormwater facilities. 981 <br />(1) Location. The subdivision shall be required by the city to carry away by pipe or open ditch any 982 <br />spring or surface water that may exist either previously to or as a result of the plat. Such drainage 983 <br />facilities shall be located in the road right-of-way where feasible, or in perpetual unobstructed 984 <br />easements of appropriate width, and shall be constructed in accordance with the city's 985 <br />construction standards and specifications. 986 <br />(2) Accessibility to public storm sewers. 987 <br />a. Where a public storm sewer is accessible, the subdivider shall install storm sewer facilities; 988 <br />or, if no outlets are within a reasonable distance, adequate provision shall be made for the 989 <br />disposal of stormwaters, subject to the specifications of the city. 990 <br />b. If a connection to a public storm sewer will be provided eventually, as determined by the 991 <br />city, the subdivider shall make arrangements for future stormwater disposal by a public 992 <br />utility system at the time the subdivision receives final approval.
