f <br /> A. <br /> City of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> CITY , NO. 1790 <br /> OF <br /> ORONO <br /> D) The property can support primary and alternate <br /> mound type septic systems. <br /> E ) The property can gain access through the <br /> undeveloped Garden Lane right-of-way. <br /> F) The applicant has demonstrated that he is aware of <br /> the potential for sewer to be installed in the area, <br /> and is aware that he risks paying for a septic system <br /> and a sewer. <br /> 4 . The City Council has considered this application <br /> including the findings and recommendations of the Orono <br /> staff and the effect of the proposed variance on the health, <br /> safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply generally <br /> to other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions , <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to pre- <br /> serve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council <br /> hereby grants a variance to the Municipal Zoning Code Section <br /> 10.03 , Subdivision 6 (A) (3 ) , to permit the construction of a <br /> single family residence on a lot of area 1.21 acres in the LR-1B <br /> zoning district, which lot is not served by municipal sewers but <br /> will be served by a septic system, subject to the following <br /> conditions : <br /> 1. Applicant shall locate the house such that the house and <br /> driveway do not encroach onto the approved drainfield sites. <br /> 2. Applicant shall be responsible for the costs of <br /> installing an adequately sized culvert in the gully location <br /> on undeveloped Garden Lane. <br /> Page 2 of 4 <br />
