287 Sec.82-3.-Scope. <br /> 288 Subdivision and platting of land in the city shall be regulated by this chapter. <br /> 289 Sec.82-4.-Policy. <br /> 290 (a) It is the policy of the city to consider the subdivision of land and the subsequent development of <br /> 291 subdivided land as subject to the control of the city pursuant to the official <br /> 292 plaeCommunity Management?lanl of the city and this chapter for the orderly,planned,efficient and i(Commented[SM18]:See previous comment. <br /> 293 economical development of the city. Commented[JB19]:Adjusted the definition. <br /> 294 (b) Land to be subdivided shall be of such character that it can be used safely for building purposes <br /> 295 without danger to health or peril from fire,flood or other menace.Land shall not be subdivided until <br /> 1296 available-adequate public and private facilities and improvements exist and proper provision has been <br /> 297 made for drainage, water, sewerage and capital improvements, such as schools, parks, recreation <br /> 298 facilities,transportation facilities and other public improvements. <br /> 299 (c) The existing and proposed public and private improvements shall conform to and be properly related <br /> 1300 to the proposals shown in the - • • • .• - .. . .• ommunity Management Plan of the city, <br /> 301 and it is intended that this chapter shall supplement and facilitate the enforcement of the provisions <br /> 302 and standards contained in the official controls and -: • .• - .• .•Community <br /> 303 Management Plan of the city. <br /> 304 Sec.82-5.-Purposes. <br /> 305 This chapter is adopted for the following purposes: <br /> 306 (1) To protect and provide for the public health,safety and general welfare of the city and to prevent <br /> 307 harm to the public health,safety and general welfare. <br /> 308 (2) To guide the future growth and development of the city in accordance with the sampreheasiv€ <br /> 309 municipal-planCommunity Management Plan. <br /> 310 (3) To provide for adequate light,air and privacy;to secure safety from fire,flood and other danger; <br /> 311 and to prevent overcrowding of the land and undue congestion of population. <br /> 312 (4) To protect the character of the land to be divided as well as the surrounding lands and the social <br /> 313 and economic stability of all parts of the city and to encourage the orderly and beneficial <br /> 314 development of all parts of the city. <br /> 315 (5) To protect and conserve the value of land throughout the city and the value of structures and <br /> 316 other improvements upon the land,and to minimize the conflicts among the uses of land. <br /> 317 (6) To guide public and private policy and action in order to provide adequate and efficient <br /> 318 transportation, water, sewerage, schools, parks, playgrounds, recreation and other public <br /> 319 requirements and facilities. <br /> 320 (7) To provide the most beneficial relationship between the uses of land and buildings and the <br /> 321 circulation of traffic throughout the city,having particular regard to the avoidance of congestion <br /> 322 in the streets and highways,and the pedestrian traffic movements appropriate to the various uses <br /> 323 of land and buildings, and to provide for the proper location and width of streets and building <br /> 324 lines. <br /> 1325 (8) To establish reasonable standards of design and procedures for subdivisions Commented[JB20]:Find and delete <br /> 326 in order to further the orderly layout and use of land;and to ensure proper legal descriptions and <br /> 327 monumenting of subdivided land. <br /> 328 (9) To ensure that public and private facilities are available and will have a sufficient capacity to <br /> 329 serve the proposed subdivision. <br /> June 15,2020 page 8 <br />
