<br />Page 2 of 2 <br />209493v1 <br />time employees are entitled to the typical number of hours that they work in a two-week period paid at <br />2/3 their normal rate of pay. <br /> <br />Full-time employees who are unable to work because of reason 5 are entitled to 12 weeks of partial paid <br />leave under the Emergency Family and Medical Leave Expansion Act. <br />Paid sick leave terminates beginning with the employee’s next scheduled work shift immediately[LK1] <br />following termination of the need of sick pay for reasons 1 thru 4. Intermittent leave is permitted for <br />reason 5. <br />Emergency Family and Medical Leave Expansion Act- Available 3/23/20 thru 12/31/20. <br />Under the Emergency Family and Medical Leave Expansion Act employees who have been employed <br />with the City at least 30 calendar days are eligible for up to 12 weeks of job-protected leave for Public <br />Health Emergency Leave. A “public health emergency” is defined to mean “an emergency with respect <br />to COVID-19 declared by a federal, state, or local authority.” <br />The act provides leave for employees who are unable to work because they need to care for a son or <br />daughter under 18 years of age whose: <br />• School or place of care has been closed, or <br />• Child care provider is unavailable due to a public health emergency. <br /> <br />The first 10 days of emergency FMLA leave may be unpaid, unless the employee chooses to use <br />available accrued paid leave or supplement with Emergency Sick Leave. <br />After the first 10 days emergency FMLA leave will be paid at a rate of 2/3 the employee’s regular rate of <br />pay capped at $200 per day ($12,000 aggregate) for the remaining duration of the leave. <br /> <br />Employees may elect to supplement accrued paid time for any unpaid time during this period. <br /> <br />Any unused paid leave granted by the Act does not carry over into 2021. <br /> <br />Paid sick leave terminates beginning with the employee’s next scheduled work shift immediately[LK2] <br />following termination of the need of sick pay.
