Then he did some additional...He raised the dock back in <br /> June. <br /> CF: And you feel this was not a quoted price to you and that's why you're not paying the full <br /> amount of$1050. <br /> EP: It wasn't quoted, and he seems to be doing whatever he wants to do. <br /> CF: What happened today then, once you came home and determined that the dock was in <br /> fact pulled out of the water. <br /> EP: Well, I couldn't even tell. I believe most of the sections are there, but I just called you <br /> guys. I just called 911. Mark had called me earlier with threatening me. <br /> CF: What did Mark say when he called you earlier? <br /> EP: That if I don't pay him by Tuesday, the dock is going to get removed by forfeiture. He <br /> also threatened that he was going to take the dock out today. <br /> CF: That message was left for you today saying that if you didn't pay by Tuesday, he was <br /> going to remove it? <br /> EP: Actually, he called me Tuesday morning telling me he was going to remove it today, and <br /> then he called me today saying I want my money otherwise Tuesday again? I don't <br /> know. It is obviously out. Most of it is out. <br /> CF: Were these voice mails that he left on your phone? <br /> EP: Yes. <br /> CF: Did you ever have direct contact with him? <br /> EP: Yeah. Well, he would just show up here abruptly sometimes. You know, like I said, he <br /> removed the dock on August 1. Came out here and took it out. <br /> CF: The entire dock? <br /> EP: Just the decking. Maybe about seven sections. <br /> CF: So all that was left were the pipes? <br /> EP: Yeah. <br /> CF: What happened then? Did you have it replaced? <br /> EP: No. I just swam out and put it together myself. <br /> CF: Okay. You then assume that he came out today. <br /> EP: Yeah, he came out. <br /> CF: Did anyone actually see Mr. Hallin on the property removing the dock? <br /> EP: No. <br /> CF: Okay. Did you have any direct conversation with him after you received the last message <br /> saying that he was going to remove it? <br /> EP: No, no. <br /> CF: You showed me a letter earlier this evening that was sent certified mail. <br /> EP: Yes. <br /> CF: Telling him to stay off this property. Were there any letters sent prior to that? <br /> EP: Sure. I believe after the August 1 incident that I sent him a letter. It was not certified. I <br /> just told him to stay away. Off my property. That I would call the police if he shows up. <br /> CF: The last few times that you had direct contact with him, did you ever advise him at those <br /> times to stay off your property and not to come back? <br /> 2 <br />
