MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 13, 2020 <br />6:03 o'clock p.m. <br />Johnson indicated Walsh was correct and noted that Item C does not require an encroachment agreement <br />Johnson made a substitute motion, Printup seconded, to remove Item A and Item B and that Item <br />C will remain and the City will commit to working with the homeowner to resolve the water issue <br />so it is not going into their property regarding the Scott and Melissa Musgjerd, 4156 Highwood <br />Road, Encroachment Agreement Request. VOTE: Ayes 4 (Johnson, Seals, Printup, Walsh), Nays 1 <br />(Crosby). <br />18. LA19-000063 — CITY OF ORONO TEXT AMENDMENT NO. 244, THIRD SERIES <br />RELATED TO SPECIAL EVENTS <br />Staff presented a summary of packet information. <br />Barnhart noted Staff recommends the State Statute version, Exhibit A. <br />Johnson moved, Crosby seconded, to approve the State Statute version of LA19-000063 — City of <br />Orono Text Amendment No. 244, Third Series Related to Special Events. VOTE: Ayes 5 (Johnson, <br />Crosby, Seals, Printup, Walsh), Nays 0. <br />19. LA20-000014 — TIMOTHY WHITTEN, WHITTEN ASSOCIATES O/B/O I JACOBS/ <br />A JACOBS REVOCABLE TRUST, 1700 SHORELINE DRIVE — SKETCH PLAN <br />Staff presented a summary of packet information. <br />Johnson asked if the property was already in the Municipal Urban Service Area (MUSA). <br />Barnhart stated that it was but there would need to be some engineering work to provide sanitary sewer to <br />all of the properties. There is a lot of work to do but it is supportable by Staff. <br />Johnson asked if the lot across the lake, on the south side of Shoreline, was a separate Planned Unit <br />Development (PUD). <br />Barnhart said they are all the same. <br />Johnson asked if Shoreline Drive was an easement. <br />Barnhart said he did not think it was an easement but it is part of the same parcel. A portion of the lot <br />shows some portion of the property south of Shoreline. <br />Johnson noted that the document indicates "Outlot C." <br />Barnhart said that is what is being shown at the sketch level. Ile imagined Outlots A, B, and C would be <br />part of Lots 1, 2, and 3 at the conclusion of the plat. <br />Johnson stated if the lots across the street are separate as outlots, Orono code will not allow them to have <br />a dock. <br />Page 21 of 25 <br />
