The City Atlorney has recon�iilended ihat if Cottncil is still oI fll� Silllle 1111I1C1 and so chooses, the moratoriuull�ngu�ge error can be corrected by simply �mending the language to exclude auy pro�erties in the defined nloratorium area which hacl zoiung applications pendilig 1t the time ihe moratorium was adopted. Staff Recommendation Si1ff would of:(�er the foliowing as general and specific guiclelules for issLtes to be considered by the Council with re;ards to ihis CUP applicatioil: 1. Is the proposed location of tlle use in accord with tlie objectives of the Zoilulg Code and the purposes of the B-1 District aud tlie Comprehensive Plan? 2. Will the location of the proposed use 1nd the proposed conditions Luider which it will be operated or maintained be detriiliental to the public health, safety welfare, or be materially injurious to properties or unprovemenis in the vicinity? 3. Is the �roposed use coi17p1tible with the suiiounding bt�siness district and zesideuti�l neighboi•hoods? If not, w1�1i aspects of ihe use make it inconipatible? Wh�t methods are �vailable to mitig�te those aspects? 4. Is the proposed use supported by adequ�te infrast�•ucture, prinl�rily lccess aud parking av�il�bility?
