The applicant has requested that the side <br /> street setback for Lot 1's north lot line be established at 20' rather than the 30' proposed <br /> by staff or the 15' required by code. While he does not have plans to build within 20' of <br /> the North Shore Drive right-of-way, he would prefer to not have to apply for variances if <br /> some portion of a proposed house or garage was less than 30' from the right-of-way, as <br /> this lot is fairly narrow. <br /> Municipal Water Connection Charge - Request for Deferred Payment <br /> The property was assessed for complete front footage but only 3 water units as part of the <br /> 1970-LW-lA municipal water project, hence 2 additional water units are due for this 5- <br /> lot plat at a cost per the 2005 fee schedule of$2,520.00 per unit, or$5,040.00 total. <br /> The City normally collects sewer and water connection charges prior to final plat <br /> approval. Applicant is requesting that this be collected at the time of building permit <br /> issuance for each of the two back lots. The City normally avoids allowing development <br /> fees to be paid with the building permit, as there is the potential for such fees to be <br /> overlooked or forgotten. <br /> COUNCIL ACTION REQUESTED <br /> Determine whether the north side street setback for Lot 1 should be 30'per staff <br /> recommendation; 20' per applicant request; or 15' per code. The language of the <br /> resolution will be modified per your action. <br /> Determine whether Council will allow the water connection charge to be collected at the <br /> time of building permit issuance for Lots 3 and 4, or require.it to be collected prior to <br /> final plat approval. The language of the resolution can be modified if necessary to reflect <br /> your action. <br />
