Gaffron- Zoning
Title: Planning Director
Item Description: OS-3161, Jared Andrews of Loucks Associates on behalf of Loren R.
Fritz, 3805 & 3845 North Shore Drive and 1635 Shadywoocl Road
- Preliminary Plat Approval - Resolution
List of Exhibits
A - Resolution
This item was placed on the consent agenda on February 27, wherein Council directed
staff to draft a resolution for preliminary plat approval. Such a resolution is attached for
Council consideration and adoption. Three specific items of note:
Trail Easement. Because the Paik Commission did not meet on March 6, there has been
no recortunendation as of yet for whether a trail easement should be required along the
northerly or easterly boundaries of the property. T/re resolution as drafted states tlzrct tf:c
developer sliall be reqccired to derlicate suc/z an easement 10' witle, eacept tlzat tliis
reqiiirenent will be elimiiiated if prior to fi.faa/ plctt approval t/re Park Comnzission
recominends atzrl the Concil cozcurs tlzat no stcch easemezt will be reqairetl.
Water Coiulection Chare. Staff has determined that the properties involved in the plat
were fully assessed for municipal sewer as part of the 1965LS-lA project, which was
assessed solely based on fiont footage. However, the 1970LW-lA muaicipal water
project was assessed based on a coinbination of fiont footage and units. For these
properties, fiill front footage was assessed, but only three units were assessed. T/terefoie,
a water corzizectiotz charge of$2,520 per unit (x2 icizits = $5,040.00) wi!!be reqctirerl.
North Setback, Lot l. Stnff is recoimeding that a 30' stricture setbck from the
no•tlz lite of Lot 1 be estreblislred. This highly visible corner lot at the intersection of
tW0 C011llt}' I'01CIS WOLIICI, by definition, have its east boundary along Shadywood as the
fi•ont lot line with a required 30' setbacl<, which is reasonable; however, its north lot line
along North Shore Drive is by definition a side lot line with a required "side street yaid"
of only 15' by LR-1C district standards. The proposed house location on applicant's
drawings shows a building envelope that meeis a 30' setback from the north 1ot line; stlff
would prefer to formalize the 30' as a requirement of this plat, rather than have some
Fiittue owiier come along and attenlpt to plce a house only 15' fi•om the North Shore
