MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday, February 13, 2006 <br /> 7:00 o'clock p.m. <br /> (#05-3131 Steve Bohl of Bohland Development, Continued) <br /> Gaffron discussed the floor area ratio for this development,noting that the applicant has indicated that the <br /> 0.4 FAR should be acceptable. The applicant has expressed a concern with the definition of whether front <br /> open porches, decks and 3-season or screen porches are included in FAR. Gaffi-on stated in his opinion <br /> an open deck does not count,but that a space enclosed Uy pernlanent walls and roof should count <br /> regardless of whether it is heated, and whether screen porches should be included are open to discussion. <br /> Gaffron noted the reduction of the FAR to 0.4 would help to limit the size of the structures on the lots. <br /> The applicant has subrnitted a conceptual landscaping plan that was created with the assistance of AES. <br /> Staff is generally in agreement with the design covenants provided by the applicant and feels that only <br /> some minor tweaking is necessary. <br /> Gaffron stated some minor issues that remain to Ue addressed include whether the church parcel, Lot 3, <br /> should be exeinpt from the SW&DT fee. Staff would note that the church properiy is being reduced in <br /> size, with the change being the addition of a trail along its southern border. In addition, some setbacks <br /> shown on the preliminary plat need to be corrected. Gaffron indicated the homeowners association would <br /> have responsibility for the stornlwater pond and the outlot, with the question of who assumes <br /> responsibility for trail maintenance from the new road to Glendale Drive still remaining unresolved. <br /> Sansevere inquired whether the City has a comparable trail elsewhere. <br /> Gaffron indicated he is aware of a ntâ–ºmber of trails that are located on private property on easements that <br /> the City or county cun-ently maintains. <br /> Sansevere inquired whether there are any developers that currently maintain any trails. <br /> Gaffron stated typically the homeowners association will maintain the trail if it is considered a private <br /> trail. Gaffron noted this trail would be a public trail and probably should be inaintained by the City. <br /> Murphy inquired what maintenance of the trail would entail. <br /> Gaffron stated if the City cunently removes snow from other trails located within the City, they would <br /> also remove the snow from this trail. Gaffron stated the City would also be responsible for replacing the <br /> trail once it reaches that point. <br /> Gaffron stated another issue with the trail was whether the crosswalk to Hackberry Park should be striped <br /> and whether the City or the developer would assume that cost. <br /> Sansevere inquired whether this would be a precedent. <br /> Kellogg stated he is not aware of another situation. <br /> PAGE 3 of 25 <br />
