c) East 160' and South 30' of Lot 3, Block 2, and those areas of said lot located <br /> more than 20' from the proposed house footprint as depicted on the Preliminary <br /> Grading Plan by Mark S. Gronberg dated 2-7-06. <br /> Applicant shall submit proposed Conservation Easement language for Council review <br /> and acceptance, specifying the proposed conditions and limitations to be placed on Outlot <br /> B and the additional areas noted above. The easement shall incorparate as a minimum, <br /> the following elements: no structures allowed, no fences, no domestic animals (i.e. no <br /> horses, sheep, chickens, etc.), no tree or vegetation removal except by special permit for <br /> maintenance or as part of an approved vegetation management plan, no excavating or <br /> earth movement; creation and maintenance of non-hardcover walking paths may be <br /> allowed. With respect to protection of the wooded steep slopes on Lots 1, 2 and 3, Block <br /> 2, special conditions shall also be established for limiting the heights, design and <br /> materials of retaining walls. <br /> Permanent markers of a design and material acceptable to the Planning Director shall <br /> be placed at all points where the Conservation Easement intersects a lot boundary or <br /> where the Easement boundary line changes direction, as noted on attached Exhibit B. <br /> 3. Prior to final plat approval, the developer shall submit an Ecological Restoration and <br /> Management Program developed by a qualified ecologist, for city acceptance. Such <br /> Program shall be implemented and adhered to, subject to a Developers Agreement to be <br /> executed between the Developer and the City. <br /> 4. Limitations on Individual Lots. <br /> A. Accessory structures: Accessory structures may be placed on lots according to <br /> City standards, with the following exception: <br /> For Lots 1, 2 and 3, Block l, no accessory structure shall be placed within <br /> 20' of the boundary of any tested and approved sewage treatment system <br /> sites; such sites and setback shall be surveyed and located on a plat <br /> drawing to be filed in the chain of title with each property with a covenant <br /> specifically providing for preservation of sewage treatment sites. <br /> B. The lot size for administering accessory structure ordinances shall be the actual <br /> contiguous dry buildable lot area; for Lots 1, 2 and 3, Block 2, the contiguous dry <br /> buildable area contained within the Conservation Easenlent shall be creditable for <br /> admirustering accessory structures ordinances. <br /> Page 6 of 12 <br />
