A RESOLUTION APPROVING <br /> CREATION OF DRIVEWAY EASEMENTS <br /> INVOLVING PROPERTIES LOCATED AT <br /> 3472 & 3480 SHORELTNE DRIVE <br /> AND 3477 LYRIC AVENUE <br /> - FILE #OS-3168 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Miiinesota; and <br /> WHEREAS, the City Cotmcil of Orono (hereinafter "C1Ly COLlI1C1I") has adopted <br /> subdivision regulations for the orderly,economic and safe developinent of land within the City; and <br /> WHEREAS,the City Council has considered tiie application for a Class I subdivision <br /> by Lyle C. Scott and Joyce E. Scott, husband and wife (hereinafter "the applicants") per Orono <br /> Municipal Code Section 82-15(a)(3)to create a driveway easement involving properties known by <br /> PIN No.s 17-1 17-23 43 0088; 17-1 17-23 43 0089; 17-117-23 43 0093;and 17-1 17-23 43 0094,said <br /> properties legally described as: <br /> Lots 11, 12, 17, and 18, Block 6, "Navarre Heights", Hennepin County, Minnesota <br /> (hereinafter "the properties"); and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning and Plaiuung Codes, the Orono Plaruiing <br /> Commission held a public heat•ing on January 17,2006 at which time all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS,the Plaiuung Conunission reviewed the proposed driveway easeinent to <br /> provide legal access from Lyric Avenue to the two lots abutting Shoreline Drive,and on a vote of 5-0 <br /> reconunended approval of creation of the proposed easements; and <br /> WHEREAS, the applicants have conlpleted all requirements of the City for the <br /> creation of a driveway easement for ingress and egress in favor of Lot 17 over Lot 12,aud in favor of <br /> Lot 18 over Lots 11 and 12. <br /> Page 1 of 3 <br />
