<br /> WFIEREAS, Bohl�uld Develo�ment Inc, (hereinafter the "Developer") has an
<br /> interest in the property within the City of Orono (hereinafter the "City") located at 3500
<br /> Watertown Road ancl legally described as follows:
<br /> Outlot A, Kintyre, Hennepin Counfy, Minnesota
<br /> (hereinafter the "Property"); and
<br /> VV�IEREAS, on August 17, 2005 the Developer filed ai1 incomplete subdivision
<br /> application with the City for preliminary approval of a six lot residential plat of the Property; anci
<br /> WHEI2�AS, after•due published and mailed notice in accordance witli Minnesota
<br /> Statl.rtes 462.358 et. seq. and the City of Oroiio Zoning aiid Subdivision Codes, the Orono
<br /> Plaiuung Conullission held a public hearing for the application and reviewed it as a slcetch plan
<br /> on Se�tember 19, 2005, at which time all persons desiring to be heard concernulg this
<br /> application were given the opportuiuty to speak thereon; a11d
<br /> VVHEREAS, on September 19, 2005 tlie P1aiuling Conunissioil reconuilended a
<br /> ziuinber of revisioils to the proposal including that it be processed as a Plaiuled Resideiitial
<br /> Developiilent (PRD); and
<br /> WHEItEAS, the applicant submitted � revised slcetch platl proposal wllich was
<br /> reviewed by the Platuling Cominissioii at a public hearing held on October 17, 2005, at which
<br /> time the Plaiuliilg Coi�unission reconui�eilded i111t the ameilded applicatioil be forw�rded to the
<br /> City Coui�.cil for confirmation th�t the PRD process was acceptaUle; and
<br /> WI3�12EAS, at i�s regulaz� mee�ing of October 24, 2005 the City Council
<br /> reviewed the sketch plan and indicated that the PRD �rocess would be �cceptable, subject to the
<br /> applicant �ddressiiig tlie City's Coi�servation Design go�ls �nd objectives, �.nd subject to c�re�'1i1
<br /> review that all st�tidards necessary to enstu�e a successful development are met; and
