#05-3131 • <br /> January 19,2006 <br /> Page 2 <br /> List of Exhibits <br /> A - Additional submittals by applicant (expected to be received January 20) <br /> B - Request for Extension of Review Period signed 12/15/OS <br /> C -Notice of Council Action 12/15/OS <br /> D - Council Minutes 12/12/OS <br /> E - Memo and Selected Exhibits of 12/8/OS <br /> Update <br /> Since the December meeting applicant has: <br /> - worked with an architect to provide renderings of how the homes will be viewed from Willow <br /> Drive <br /> - suggested a variety of covenants or design guidelines with regard to home design and <br /> landscaping <br /> - inet with staff, City consultants, his own consultants and the MCWD in a ineeting on January <br /> 18 to discuss the issues of wetland impacts, mitigation, and the possibility of some flexibility in <br /> the wetland buffer or buffer setback for Lot 10, which abuts Willow Drive. The problem area <br /> is that the road ditch along Willow is delineated as wetland. City consultants consider this <br /> ditch an incidental wetland, only eaisting because the road is there. However, applicant is not <br /> allowed to conduct both a deininiinus fill of 2000 s.f. of in Lot 8 and fill an incidental wetland, <br /> without mitigation. There is very limited area on the site remaining for possible mitigation, as <br /> most of the logical mitigation area adjacent to the wetlands is within building lots or being <br /> used for stormwater ponding. The 25' buffer plus 20' buffer setback imposed by the City from <br /> this ditch wetland places some significant width constraints on any house that would be built <br /> on Lot 10. Because this development is being proposed as an RPUD, staff would support some <br /> measure of buffer or setback reduction/variance based on this being a ditched/incidental <br /> wetland, if applicant is unable to satisfy MCWD/WCA requirements for mitigation. <br /> - worked with AES to begin addressing the elements of Conservation Design <br /> As of this writing, only drafts of new information lzave been submitted. Applicant has indicated <br /> his new subinittals will arrive Friday for late inclusion in the packet. <br /> Staff Recommendation <br /> Review the topics noted above with the applicant. A site visit by the Council with the applicant <br /> may be usefi�l in considering the various elements of this proposal. Note that applicant has <br /> provided an extension of the foimal review period to February 17. Staff's goal is to present a <br /> resolution for preliminary plat approval to Council for consideration and possible adoption at <br /> your February 13 meeting. <br /> COUNCIL ACTION REQUESTED <br /> Applicant will be appearing Monday night to provide you an update of the status of this <br /> application, allowing Council to react to the newest sLtbmittals, and provide additional direction. <br />
