, . <br /> � ` , ' , '' �—, <br /> . ► ,�� j V%� !�� <br /> %:',�I'� / <br /> , <br /> '� l� ���-c�, <br /> ~ ��,�, �7,�� , _ <br /> ��p����-�°� a�; �. <br /> ��,c c�+ c,�q/����.r�,,,,fa <br /> AGREEMENT <br /> This is an Agreement between�the City of Long Lake, Minnesota(Long Lake) and the <br /> City of Orono, Minnesota(Orono), collectively cailed the Parties(the Parties), on certain matters <br /> with respect to the joint development of a fire station situated within the City of Orono. <br /> WHEREAS,the Parties have entered into a previous Agreement on August 8, 2001 <br /> (Settlement Agreement) far the joint construction, ownership and operation of a new fire station; <br /> and <br /> WHEREAS,pursuant to the Ageement of August 8, Z001, the Parties have agreed to <br /> purchase property in (Orono for the new fire station site. The fire station site is a portion of a <br /> larger parcel legally described as Lot 1, Blocic 1,Willowfire Addition(the "Parcel"); and <br /> WHERFAS, certain matters have arisen with respect to the development of this Parcel <br /> which the Parties dcsire to resolve and memorialize as an enforceable Agreement; <br /> NOW, THEREFORE, Long Lake and Orono, for good and valuable consideration, <br /> receipt of which is mutually acknowledged, do agrea as follows: <br /> 1. The Parties agree that the Parcel will be served by a public road which will � <br /> provide access to the fire station and to the outlot created to the east of the fire station. The <br /> public road is shown on the attached Exhibit A. The construction cost of this road will be funded <br /> from the joint fire station account, as created by the Agreernent of August 8,2001. The fire <br /> station account will be reimbursed for SO%of the construction cast of the road,plus interest at <br /> tl�e annual rate of 4%, wl�en the outlot to the east of the fire station is developed. <br /> 2. The Minnesota Department of Transportation has agreed to pay the full cost of <br /> providing a sewer line to seive the fire station. The sewer will cross the Parcel approximately as <br /> shown on Exhibit A. The Parties agree that the sewer l'u�e may be built to specifications which <br /> provide for �eater sewer line depth than the sewer Iine for which the Mimiesota Department of <br /> Transportation has agreed to pay. The Pail:ies estimate the additional expense of the deeper <br /> sewer line to be approximately$70,000.00. Orono agraes to pay the additional costs. <br /> 3.
