The City will bill the School District monthly. Payments for the School District's utilization <br />of the fuel station shall be made in a lawful manner. The School District will normally pay for <br />services within thirty (30) days of receipt of a statement for fuel pumped, taken, spilled, or utilized <br />from the fuel station. The fees and costs for the utilization of the fuel station will vary, and the <br />School District agrees that it will pay the City for all fuel it pumps, takes, spills, or utilizes from the <br />City's fuel station at the price the City sets in its sole discretion. <br />4. COMPLIANCE WITH LAWS AND REGULATIONS. <br />When utilizing the City's fuel station, the School District shall abide by all laws, statutes, <br />ordinances, rules, and regulations. Any violation shall be a material breach of this Agreement <br />and entitle the City to immediately terminate this Agreement. <br />5. WAIVER. <br />Any waiver by either party of a breach of any provisions of this Agreement shall not <br />affect in any respect the validity of the remainder of this Agreement. <br />6. INSURANCE. During the term of this Agreement, the School District shall <br />maintain a general liability insurance policy with limits of at least $1,500,000 for each person, <br />and each occurrence, for both personal injury and property damage. This policy shall name the <br />City as an additional insured for the services provided under this Agreement and shall provide <br />that the School District's coverage shall be primary coverage in the event of loss. The policy <br />shall also insure the indemnification obligation contained in Paragraph 7. A certificate of <br />insurance must be provided to the City before the School District may use the fuel station under <br />this Agreement. <br />7. INDEMNIFICATION. <br />Error!
