SEP- 13. 2006 11 :40AM Mail EDINA REALTY TITLE CLAIMS N0. 2964 P. 36/59 <br /> not meet the Committee's standards of creditworthiness and/or does not build homes <br /> of the same quality as are intended to be constructed or have been constructed on the <br /> Real Property_ <br /> (b) Noncompliance with this Declaration. <br /> (c) Failure of Improvements to be of a style or design compatible with,or of the same <br /> general size,quality of construction and price range as Improvements built or to be <br /> built on the Lots within the Real Properly. <br /> (d) Failure of Improvements to be placed and oriented on a Lot in a manner <br /> compatible with the Improvements built or intended to be built on the Lots <br /> within the Real Property and in a manner compatible with the terrain of the Lot; <br /> (e) Failure of Improvements otherwise to be in harmony of external design, style <br /> and location with and in relation to surrounding structures, Improvements, <br /> vegetation and topography. The Committee may require Improvements to be <br /> located farther from the side,front or rear lot lines than the minimum building <br /> setback requirements of City; <br /> (f) Failure of a fence to be compatible with Improvements on adjoining Lots,and <br /> with the character of the Plat as a whole,in terms of height,location,design, <br /> materials and/or obstruction of views. <br /> (g) Failure of the plans and specifications to show all information necessary to <br /> evaluate the foregoing characteristics. <br /> Section 4.Notice to Owner.The Committees determinations concerning proposed <br /> Improvements shall be conclusive.If the Comumittee disapproves of a contracto:r or of plans and <br /> specifications for proposed Improvements,it shall notify the Owner,in writing,of such <br /> disapproval and,in the case of disapproval of plans and specifications,the matters that must be <br /> cared to obtain approval.
