I am fine with what they are proposing, but I would put a condition on the permit stating all the landscaping needs to occur outside of this easement unless they want to enter into an encroachment agreement and have them sign off on it. This will at least make the homeowners aware of the condition in case the landscaper installs the landscaping within the easement area because it will be something I will check with their as-built submittal. While I will sign the permit and can approve the grading within the City easement,the applicant needs to be aware that any plantings, mulch, rock,or any other sort of landscape material besides grass is not allowed within the City's easement without an encroachment agreement. If they want to pursue to place any landscape material besides grass,they will need to enter into an encroachment agreement with the City prior to any work being performed. The applicant also needs a permit from MCWD prior to issuing our grading permit.
