r I KAM ER ENTERED <br /> DEPT.OF PROPERTY TAX&PUBLIC RECORDS <br /> O JUL 9 1 1 <br /> \, H N MINN. <br /> B r <br /> CITYof O <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> \ kESHOg%7 NO. 2970 <br /> A RESOLUTION APPROVING THE PLAT OF <br /> FAIRWAY HILLS ADDITION <br /> FILE NO. 1615 <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WHEREAS, the City Council of the City of Orono has <br /> adopted subdivision regulations for the orderly, economic and <br /> safe development of land within the City; and <br /> WHEREAS , the City Council has considered the <br /> application for a subdivision of a two lot plat by Kenneth R. <br /> Hopkins and Gary D. Mroz, hereinafter "the subdividers"; and <br /> WHEREAS, the subdivision has been found to meet all <br /> standards of the RR-1B rural residential zoning district finding <br /> that each lot is of a size and configuration that will allow its <br /> use as a single family residence to be fully developed without <br /> the need of any variances; and <br /> WHEREAS, a portion of the property has been assessed a <br /> sewer and water unit, the City Council approved sewer and water <br /> services to both Lots 1 and 2, although both lots meet the <br /> required rural standards for residential development; and <br /> WHEREAS, the subdivider has completed all requirements <br /> of the platting regulations of the City, including: <br /> 1. Completion of all the requirements of Resolution #2927. <br /> 2. Dedication on the plat of right-of-way for a public road <br /> shown as State Highway No. 12. <br /> 3. Creation of a new private driveway shown on the plat as <br /> Outlot A. <br /> 4. Concurrent with the creation of this private driveway, <br /> the subdividers have dedicated to the City utilities and <br /> access easements granting to the City permanent access, <br /> improvement and utility easements over said outlot; the <br /> subdividers have created a declaration of certain <br /> maintenance covenants wherein each of the abutting and/or <br /> benefitting lot owners covenants and agrees to permanently <br /> maintain and pay the cost of maintenance for said private <br /> driveway. <br /> Page 1 of 3 <br />
