To allow a use which is reflective of anticipated long range change to an area and which is in <br /> 843 compliance with the comprehensive plan provided that said use maintains harmony and <br /> 844 compatibility with surrounding uses and is in keeping with the architectural character and design <br /> 845 standards of existing uses and development. <br /> 846 (Ord.No. 194 3rd series,§1,5-8-2017) <br /> 847 Sec.78-1746.-Application procedure. <br /> 848 The information required and the procedures to be followed for all interim use permit applications <br /> 849 shall be the same as that required for a conditional use permit as provided for in this chapter in sections <br /> 850 178-912 through 78-9171.In addition,the following information shall be provided: i Commented 1JBI8]:Process to review CUP's. <br /> 851 (a) Written documentation that includes a complete description of the use, schedule for <br /> 852 commencement and termination of the use, hours and dates of operation and anticipated <br /> 853 employment. <br /> 854 (b) Any special studies requested by the city when there is evidence that the proposed use may <br /> 855 negatively impact public infrastructure,the environment or adjacent land uses.These studies may <br /> 856 examine the impacts on such things as traffic,environment,wetlands and utilities. <br /> 857 (c) Evidence of approval or preliminary approval from all other agencies with jurisdiction over <br /> 858 elements of the use. <br /> 859 (Ord.No. 194 3rd series,§ 1,5-8-2017) <br /> 860 Sec.78-1747.-Standards and conditions. <br /> 861 No interim use permit may be granted unless the city council determines that the use will comply <br /> 862 with the following: <br /> 863 (a) The use will meet the general performance standards in section 78-916 of this chapter; <br /> 864 (b) The use is allowed as an interim use in the applicable zoning district; <br /> 865 (c) The use will not delay anticipated development or redevelopment of the site; <br /> 866 (d) The use will not be in conflict with any provisions of the city code on an ongoing basis; <br /> 867 (e) The use will not adversely affect the adjacent property,the surrounding neighborhood,or other <br /> 868 uses on the property where the use will be located; <br /> 869 (f) The use will not impose additional unreasonable costs on the public; <br /> 870 (g) The date or event that will terminate the use can be identified with certainty;and <br /> 871 (h) The applicant agrees in writing to any conditions that the city council deems appropriate for the <br /> 872 use,including a requirement for a financial security to ensure removal of all evidence of the use <br /> 873 upon termination,and restoration of the site to prior or better conditions.The conditions shall be <br /> 874 set forth in a development agreement between the property owner and the city,which agreement <br /> 875 shall be recorded with the Hennepin County Recorder or Registrar of Deeds. <br /> 876 (Ord.No. 194 3rd series,§ 1,5-8-2017) <br /> 877 Sec.78-1748.-Effect of permit. <br /> 878 (a) An interim use permit is effective only for the location specified in the approval documentation. <br /> 879 (b) The issuance of an interim use permit does not confer on the property any vested rights. <br /> Page 24 <br />
