236 a. The prevention of soil erosion or the possible pollution of public waters,both during and <br /> 237 after construction; <br /> 238 b. The visibility of structures and other facilities as viewed from public waters is limited; <br /> 239 c. The site is adequate for water supply and on-site sewage treatment;and <br /> 240 d. The types,uses and numbers of watercraft that the project will generate are compatible in <br /> 241 relation to the suitability of public waters to safely accommodate these watercraft. <br /> 242 (2) Conditions attached to conditional use permits. The city council upon consideration of the <br /> 243 criteria listed in subsection(1)of this section and the purposes of this article, shall attach such <br /> 244 conditions to the issuance of the conditional use permits as it deems necessary to fulfill the <br /> 245 purposes of this article.Such conditions may include but are not limited to the following: <br /> 246 a. Increased setbacks from the ordinary high water level. <br /> 247 b. Limitations on the natural vegetation to be removed or the requirement that additional <br /> 248 vegetation be planted. <br /> 249 c. Special provisions for the locations,design and use of structures,sewage treatment systems, <br /> 250 watercraft launching and docking areas,and vehicle parking areas. <br /> 251 (Ord.No. 101 2nd series,§ 1(10.56(13)),2-24-1992) <br /> 252 Sec.78-1251.-Notifications to the department of natural resources. <br /> 253 Copies of all notices of any public hearings to consider variances,amendments or conditional uses <br /> 254 under this article must be sent to the commissioner of the department of natural resources and postmarked <br /> 255 at least ten days before the hearings.Notices of hearing to consider proposed subdivisions/plats must <br /> 256 include copies of the subdivision/plat.Upon final action by the city council,a copy of approved <br /> 257 amendments and subdivisions/plats,and final decisions granting variances or conditional uses under this <br /> 258 article must be sent to the commissioner of the department of natural resources and postmarked within ten <br /> 259 days of final action. <br /> 260 (Ord.No. 101 2nd series,§1(10.56(14)),2-24-1992) <br /> 261 Sec.78-1252.-Nonconformities. <br /> 262 All legally established nonconformities as of February 24, 1992,may continue subject to applicable <br /> 263 state statutes and as regulated elsewhere in this Code.In shoreland areas,the following standards shall <br /> 264 also apply: <br /> 265 (1) Construction on nonconforming lots of record. Development or use of existing lots of record <br /> 266 shall be regulated as set forth in section J78-72 Commented[JB5]:Lots of Record <br /> 267 (2) Additions/expansions to nonconforming structures. All additions or expansions to the outside <br /> 268 dimensions of an existing nonconforming structure must meet the setback, height, and other <br /> 269 requirements set forth in this chapter.Any deviation from these requirements must be authorized <br /> 270 by a variance pursuant to provisions of this chapter. <br /> 271 (3) Nonconforming sewage treatment systems. A nonconforminz sewage treatment system(also <br /> 272 defined as a noncompliant system)as defined in section 158-41 and located within the Shoreland Commented[JB6]:Chapter 58 is SSTS regulations <br /> 273 Overlay District must be upgraded and made conforming,at a minimum,at any time a permit or <br /> 274 variance of any type is required for any improvement on, or use of,the property, except that <br /> 275 systems which are noncompliant due solely to lack of three feet of unsaturated soil or sand <br /> 276 between the distribution device and the limiting soil characteristics shall have seven years in <br /> 277 which to become compliant per the provisions of chapter 58,article II,of this Code.All other <br /> Page 18 <br />
