MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,December 9,2019 <br /> 6:30 o'clock p.m. <br /> Walsh confirmed he did and that it would be up to Mattick, understanding where the City Council is <br /> going with it and with Staff knowing all the feedback. <br /> Mattick said he does not necessarily hear a desire to take what's on the books off the books,but perhaps to <br /> expand what is allowed in this particular situation. <br /> Walsh stated the Council wants to give someone in the interior of an island, and dedicate what those <br /> islands could possibly be, an easement from a neighbor to be able to get lake access. <br /> Johnson added that is something everyone wants except one neighbor to the east. <br /> Walsh stated it's a denial because it does not make any sense and he thinks everybody is in agreement. He <br /> asked if everybody is in agreement to have Mattick work with Staff to come up with a very tight-knit <br /> exception rule to the ordinance the City has,because the City has islands that have no roads or anything <br /> else to them. <br /> Barnhart suggested a table action and then let Staff come back with an ordinance that allows the direction <br /> the Council has provided and then the City Council can make a decision based on two options available. <br /> If it is denied and the Council does not end up approving an ordinance,the Council has taken away the <br /> ability for the property owner to have the access. If there are a couple of options, Staff can move forward <br /> before the City Council makes a final decision. <br /> Walsh stated that would be fine. He did not think the City Council would approve it either way because of <br /> the access. <br /> Crosby asked why the City Council couldn't deny. <br /> Walsh clarified Staff is saying leave the door open just in case something weird happens and the City <br /> Council gives them access and says, "That's where you're going to have access"even though they don't <br /> want it there. <br /> Walsh responded in the affirmative. <br /> Crosby said he did not see that happening. <br /> Barnhart stated from a Staff perspective the concern is that the City Council is putting all of the ability for <br /> this property owner to have access to her property through another property, and if they can't come to an <br /> agreement,they don't have options available to them. <br /> Walsh said it would be hard for them to come to an agreement until they know they have an ordinance <br /> that lets them come to an agreement and tabling it doesn't hurt anybody. <br /> Johnson asked if the Council is talking about amending the Code to allow anyone to do this. <br /> Walsh said it would be for two particular islands and it would be very, very specific. <br /> Johnson asked what the zoning district was. <br /> Page 23 of 34 <br />
