MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,December 9,2019 <br /> 6:30 o'clock p.m. <br /> Walsh agreed it was possible. <br /> Johnson said it would have to be approved by the Council. What he likes about denying it on the City <br /> land is,there are quite a few more interior lots.This applicant owns two. From what he can tell, one of <br /> them is for sale. He does not know if they are putting both in there, but the City could be looking for a <br /> place for a second dock. <br /> Walsh stated it wouldn't be the City. <br /> Johnson said now there's an ordinance in place that says they can put a dock there,but the other ones that <br /> are in the interior are muted by the fact that they're owned by people that have lakeshore. The ones to the <br /> north are owned by people that already have their lake access through their own lot so it's not an issue,but <br /> at some point, it could become an issue. He asked what the City would do if there are six interior lots <br /> demanding a spot for their boat. <br /> Council members gave opinions on whether that is allowed, it could be requested or approved. <br /> Walsh stated the City land is not a feasible place to put a dock. <br /> Johnson agreed and said that is why there is some latitude within that ordinance about the City saying <br /> where it can be and they can approve it and it's annually renewable and can be cancelled by the City. He <br /> wanted everybody to be mindful that there are other ones there. <br /> Walsh said that is why the City needs to sculpt the language very tightly as far as what it applies to. <br /> Johnson noted the property owner would need cooperation from the LMCD. <br /> Walsh stated the City can't solve that issue. He said if that gives them lake right access,then they should <br /> be able to get a dock from the LMCD. <br /> Printup asked if there is anything the City should do to make it very clear why the City does not want it in <br /> the City Right-of-Way, such as the danger and the barges and the flow of traffic. <br /> Walsh noted at the Planning Commission a lot of the neighbors said, because of the width, if you put a <br /> dock there, a barge bringing materials there could get there but they would probably be parking on private <br /> property. Then there are issues with barges going on private property versus the access that's supposed to <br /> be for them, and who can and can't go on the dock. <br /> Johnson added there's power lines and dock storage issues. <br /> Walsh confirmed there's power lines under the water in the mud and said if someone hit one of those,who <br /> knows what could possibly happen. He does not think anything shows or anyone knows where that is <br /> located under the water. <br /> Crosby asked if Walsh wanted the City to draft something on this item. <br /> Page 22 of 34 <br />
