The pond will treat the runoff upstream discharge area before it is <br /> discharged downstream, ultimately flowing through Peavey Lake into Lake <br /> Minnetonka. <br /> c. To mitigate the loss of 0.55 acre of wetland 0.74 acre of wetland and 1.11 <br /> acres of wetland buffer are being created. <br /> 3. The Planning Commission reviewed this application on January 20, 2009 and <br /> on a vote of 7 - 0 recommended approval of the conditional use permit. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the owners and the public, and the effect of the proposed <br /> conditional use on the health, safety and welfare of the community as well as <br /> the impact on properties in the vicinity. <br /> 5. The City Council finds that granting the conditional use permit is in accord <br /> with the objectives and purposes of the RR-1B zoning district in which the site <br /> is located and of the City's wetland protection regulations as well as with the <br /> comprehensive municipal plan. The City Council also finds the proposed <br /> wetland and land alteration would not be detrimental to the public health, <br /> safety or welfare, or materially injurious to properties or improvements in the <br /> vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a conditional <br /> use permit for wetland alteration and for land alteration to convert a ditch with wetland <br /> qualities to a pond and to excavate three areas to provide for replacement of the wetland, <br /> subject to the following conditions: <br /> 1. Council approval is based on the plans submitted by the applicant and attached to this <br /> Resolution as Exhibit B. Any changes or amendments to this plan will require further <br /> Planning Commission and City Council review. <br /> 2. Provision of the standard flowage and conservation easement and restrictive <br /> covenant over the wetlands and wetland buffers or equivalent. <br /> Page 2 of 4 <br />
