<br />APPROVING A VARIANCE FROM
<br />MUNICIPAL ZONING CODE

<br /> WHEREAS, on September 16, 2019, David Royal and Stacey Royal, a married
<br />couple, (hereinafter the “Applicants”), applied for a variance from the City Code for the property
<br />addressed 3135 Jamestown Road and legally described as:
<br />
<br />Land referred to in this commitment is described as all that certain property
<br />situated in the County of Hennepin, and State of Minnesota and being described in a
<br />deed dated 07/24/2006 and recorded 08/11/2006 in instrument number: 8844563
<br />among the land records of the County and State set forth above, and referenced as
<br />follows:
<br />Lot 3, Block 1, Liberty Acres, except that part of said lot lying northeasterly of
<br />a line drawn from the most westerly corner of Lot 4, said Block 1, to a point of the east
<br />line of said Lot 3 distant 486 feet north from the southeast corner of said Lot 3; and an
<br />undivided one-fifth (1/5) interest in Outlot A, Liberty Acres; together with a permanent
<br />nonexclusive easement over, under and across the following described property for
<br />ingress, egress and utility purposes, Outlot A, Garden Grove and the north 66 feet of
<br />the west 66 feet of the southeast one quarter of the southwest one quarter of Section
<br />28, Township 118, Range 23, except that part of Lot 3, Block 1, Liberty Acres,
<br />described as follows: beginning at the most easterly corner of Lot 2, Block 1, Camelot;

<br />of said Lot 2, a distance of 198.33 feet; thence north 47 degrees 00 minutes, 00
<br />seconds east a distance of 123.90 feet; thence north 14 degrees, 00 minutes, 00
<br />seconds east to the north line of said Lot 3; thence westerly along said north line to
<br />the point of beginning, Hennepin County, Minnesota, and
<br />That part of Lot 2, Block 1, Camelot, described as follows: commencing at the
<br />most easterly corner of said Lot 2; thence south 26 degrees, 00 minutes, 00 seconds
<br />west along the southeasterly line of said Lot 2, a distance of 198.33 feet to the point
<br />of beginning of the parcel being described; thence south 47 degrees, 00 minutes,00
<br />seconds west a distance of 54.10 feet; thence south 26 degrees, 00 minutes, 00
<br />seconds west to the shore of Lake Classen; thence southeasterly along said shoreline
<br />to the intersection with a line drawn south 26 degrees, 00 minutes, 00 seconds west
<br />from the point of beginning; thence north 26 degrees, 00 minutes, 00 seconds east
