<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-305, 78-72 <br /> <br />FILE NO. LA19 -000083 <br /> <br /> WHEREAS, on October 2, 2019, Jim Cleary Everlast Enterprises Inc (“Applicant”), <br />applied for a variance from the City Code for the property addressed 315 Crestview Ave and legally <br />described as: <br /> <br />Lots 1 and 2, Block 5, BAYSIDE ADDITION TO LAKE MINNETONKA, and the south half of <br />vacated Hill Street which lies between the northerly extensions of the east and west lines of <br />said Lot 1, according to the recorded plot thereof, Hennepin County. Minnesota. (hereinafter <br />the “Property”); <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section78-305 allow a front setback of 30.2 feet and a <br />rear setback of 46.3 feet where 50 foot setback is required; and <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section78-72 for lot area and lot width to construct a <br />new home on a substandard lot; and <br /> <br /> WHEREAS, on October 21, 2019, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br /> <br /> WHEREAS, on October 21, 2019 the Planning Commission recommended <br />approval of the variance; and <br /> <br /> WHEREAS, on November 12, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variance as described above based on one or more of the <br />following findings of fact concerning the Property: <br /> <br />FINDINGS OF FACT: <br />
