<br /> 1 <br />ORDINANCE NO. ___, THIRD SERIES 1 <br /> 2 <br />CITY OF ORONO 3 <br />HENNEPIN COUNTY, MINNESOTA 4 <br /> 5 <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES 6 <br />PERTAINING TO AVERAGE LAKESHORE SETBACK 7 <br /> 8 <br /> 9 <br /> 10 <br />THE CITY COUNCIL OF ORONO ORDAINS: 11 <br /> 12 <br />SECTION 1. Chapter Sec. 78-1279 Placement of Buildings and structures on lots 13 <br />shall be amended to read as follows: 14 <br /> 15 <br /> (6) Average lakeshore setback. No principal or accessory building shall be located closer to 16 <br />the lakeshore Ordinary High Water Line (OHWL) than the average distance from the shoreline 17 <br />of existing residence buildings on adjacent lots; The most lakeward protrusion except that tThis 18 <br />does not apply to patios and other accessory structures less than 42 inches above existing 19 <br />grade, stairways, lifts, landings, lockboxes, flagpoles and pump houses. Further, the average 20 <br />lakeshore setback shall apply only to classified lakes and shall not apply to tributaries. The 21 <br />average lakeshore setback line shall be a straight line connecting the most lakeward 22 <br />protrusions of the residence buildings on the immediately adjacent lakeshore lots. 23 <br />a. In situations where improvement is proposed on a lot adjacent to a vacant lot or right-24 <br />of-way, the average lake shore setback shall be equivalent to the setback of the most 25 <br />lakeward protrusion of the residence building on the immediately adjacent improved 26 <br />lakeshore lot. 27 <br />b. In situations where the average lake shore setback line bisects the principal structure 28 <br />building located on either adjacent lot, the next most adjacent lake side point of the 29 <br />bisected principal structure building shall be used for determining the average 30 <br />lakeshore setback. If the line continues to bisect the structure, the next most lakeside 31 <br />point is to be used until the setback line does not bisect the building on an adjacent lot. 32 <br />SECTION 2.
