To consider an amendment to the City Code related to Average Lake Shore Setback. <br /> <br />2. Background. At its meeting on September 9th, the Council directed staff to prepare an ordinance <br />for adoption, reflecting desired language offered by the Mayor. On September 23rd, an ordinance <br />was presented, triggering additional discussion. <br /> <br />Based on this discussion, adjustments were made to the final ordinance, including a definition of <br />Lakeshore (replaced with Ordinary High Water Line, a defined term) and how to respond when <br />multiple lakeward points yield a bisecting line. There was some discussion about how the nearest <br />lake ward projection of the adjacent homes are determined. In instances when the surveyor <br />cannot obtain permission to accessor a neighboring property, the city has and will continue to <br />accept information based on satellite imagery. <br /> <br />As directed by the Council, the resulting ordinance does not introduce wholesale changes to the <br />Average Lake Shore regulations and will impact a small percentage of lake lots. <br /> <br />3. Public Comment. All written comments received have been provided. <br /> <br />4. Staff Recommendation. Staff recommends adoption as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should adopt the ordinance as drafted. <br /> <br />Exhibits <br />A.
