If the applicant is willing to make that change, that is where it should be. They can use <br /> the tree as a reference point in the field and go from there. <br /> Ressler asked how Staff would propose to make that amendment. <br /> Curtis stated the Planning Commission could make a motion consistent with the spirit of the red line and <br /> not approve a specific number at this point. The City Council will be getting that direction and the <br /> applicant is getting that direction tonight. <br /> Erickson stated they could approve it as amended by the applicant. <br /> Ressler asked if the applicants would be agreeable to the Planning Commission approving it based on the <br /> red line. <br /> Mr. and Mrs. Ties stated they are. <br /> Gettman commented he is not sure if all the neighbors are comfortable with that red line. <br /> Curtis noted there is only one neighbor that is affected. <br /> Erickson moved,Thiesse seconded,to recommend approval of Application No. LA19-000067, <br /> Kathryn Alexander,3129 Casco Circle,average lakeshore setback variance,based on the <br /> information as reviewed by Staff but also including the red line that runs through the tree as <br /> proposed by the applicant. VOTE: Ayes 5,Nays 1,Gettman opposed. <br /> 3. LA19-000068 ERIC JOHNSON,580 ORCHARD PARK ROAD,VARIANCE,7:31 P.M.— <br /> 7:38 P.M. <br /> Eric Johnson,Applicant, was present. <br /> Oakden stated the applicant is requesting a front yard setback. The property is located in the RR-1A <br /> zoning district,which is a 5-acre district, and has a 100-foot front yard setback. The property includes an <br /> existing farmhouse that is being remodeled. It sits entirely within the required front yard setback. <br /> According to Hennepin County,the home was built in the1940s. <br /> The applicants are proposing to enclose the existing deck on the back side of the home as a screened-in <br /> porch and add a landing for a back door from the home. Due to the location of the existing legal <br /> nonconforming home,there is no conforming building space to allow for additions since the home sits <br /> entirely within the100-foot front yard setback. The proposed improvements will fit within the existing <br /> setbacks. No new setbacks are proposed. The property is outside the Shoreland regulations and has no <br /> hardcover limits. <br /> To date no public comments have been received. Three neighbors have signed off on the project. <br /> Planning Staff recommends approval. <br /> Ressler asked if the garage would be actually intensifying the use. <br /> Page 9 of 24 <br />
