CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION <br />ACCEPTING THE SANITARY SEWER UTILITY WITHIN OLIVER HILL <br />AS PUBLIC FACILITIES <br />WHEREAS, on September 30'h, 2014 the City of Orono and The Broadway Group, <br />LLC entered into Development Contract and Residential Planned Unit Development Agreement, <br />Oliver Hill, 13-3637 / 14-385, PUD#8 (the "Contract") which documented the terms and <br />conditions under which the development known as Oliver Hill was approved; and <br />WHEREAS, the terms and conditions of the Agreement in Subsection 1)(8)(1) state that <br />final acceptance of the improvements to be publicly owned, including, sanitary sewer, shall take <br />the form of a Resolution passed by the Orono City Council, on the advice of the City Engineer; <br />and <br />WHEREAS, the City Engineer has recommended that the City formally accept the <br />Improvements; and <br />NOW, THEREFORE BE IT RESOLVED that the City Council of Orono does hereby <br />formally accept the Public Improvements (Sanitary Sewer Utility) associated with Oliver Hill <br />and shall assume ownership and maintenance of said facilities. <br />Adopted by the City Council of Orono, Minnesota this 26th day of August, 2019. <br />ATTEST: <br />Anna Carlson, City Clerk Denis Walsh, Mayor <br />
