"The conditions do not apply generally to other land or structures in the district in which <br /> said land is located." <br /> As outlined above, the property and structures at 2090 Shoreline Drive are unique and peculiar. <br /> This large four-acre parcel of land is still used as a summer-only residence and is virtually <br /> invisible from adjacent properties and neighborhoods. The existing and proposed hardcover on <br /> the property comprises approx. 14% of the parcel. The main residential structure and the guest <br /> house constitute about 3% of the hardcover on the property. The owner has a desire to maintain <br /> and improve the unique characteristics of the property and support the original use of the <br /> property for future generations of the family. The owner is committed to preserving the property <br /> as well as enhancing the historic nature of the property. <br /> 10. "The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant." <br /> The granting of a variance from the average Lakeshore setback, as outlined in Sec 78-1279 (6), will <br /> allow the property owner to preserve the existing character of the property and maintain and <br /> restore the historic summer residence which is unique to the property. The property also features <br /> a guest house, a well-designed and maintained garden and a couple of unique accessory <br /> structures. The property owner and her heirs are committed to act as stewards of this special <br /> property well into the future. The property is a family legacy and the granting of a variance to the <br /> average lakeshore setback is a necessary component of its future preservation. <br /> 11. "The granting of the proposed variance will not in any way impair health, safety, <br /> comfort, morals, or in any other respect be contrary to the intent of the Zoning Code." <br /> The proposed changes to the property will not impair health, safety, comfort, morals or be <br /> contrary to the intent of the current zoning ordinances. Means and methods of construction will <br /> be specified to protect the existing property and maintain and restore its original structures. Best <br /> practices will be used to ensure that soils are not disturbed and that all means to protect the <br /> delineated wetland and shoreline will be used. <br /> 12. "The granting of such variance will not merely serve as a convenience to the applicant, <br /> but is necessary to alleviate demonstrable difficulty." <br /> The granting of the variance from the average lakeshore setback does not constitute a <br /> convenience for the property owner, but allows for the continued use of an historic structure and <br /> family summer residence, in use for nearly 100 years by the same family. Granting a variance to <br /> the average Lakeshore setback will resolve the demonstrated practical difficulties outlined above <br /> and documented in the attached survey and drawings. <br />
