1.1.13 "Entrance Monument" shall mean one or more entrance monuments for <br /> Crvstal Creek to be constructed by the Declarant on the real property iegally described on <br /> ir!it B attached hereto, and to be maintained by the Association in accordance with the <br /> provisions of this Declaration. <br /> 1.1.14 "Lot" shall mean and refer to any lot located within the Property which is <br /> platted as a residential lot and which is intended for use as, or used as; a site for a s1112le <br /> Dwelling, but shall not include anv Outlot located \\•)thin the plat of Crystal Creek. <br /> 1.1.15 "Member." Each Owner entitled to membership in the Association pursuant <br /> to the provisions of Article 11. <br /> 1.1.16 "Mortgage" shall mean and refer to a deed of trust, mortgage, contract for <br /> deed, or other security instrument granting, creating or conveying a lien upon, a security <br /> interest in, or a security title to any portion of the Property, or any interest therein. <br /> 1.1.17 "Mortgagee" shall mean and refer to any entity or person named as mortgagee <br /> in any mortgage deed granting a lien ("Mortgage") on any Lot. <br /> 1.1.18 "NURP Ponds/Drainage Ways" shall mean the areas reflected as Drainaue <br /> Easements on the Plat of Crystal Creek. <br /> 1.1.19 "Owner." The record Owner or contract vendee of the fee simple title to an), <br /> Lot, but excluding contract vendors, mortgagees or any others having such interest merely <br /> as security for the performance of an obligation. <br /> 1.1.20 "Private Roadway" shall mean the roadway constructed over Outlot A, Crystal <br /> Creek, according to the plat thereof on file or of record in the Office of the County Recorder <br /> in and for Hennepin County, Minnesota. <br /> 1.1.21 "Property" shall mean and refer to that real property legally described in <br /> Exhibit A, attached hereto and made a part hereof. <br /> 1.1.22 "Temporary Cul-de-sac" shall.mean a temporary cul-de-sac to be constructed <br /> over the area legally described on Exhibit D attached hereto. <br /> ARTICLE H <br /> MEMBERSHIP AND VOTING RIGHTS IN THE ASSOCIATION <br /> Section 2.1 Membership. Each Owner of a Lot is a Member of the Association. <br /> Membership shall be appurtenant to and may not be separated from ownership. <br /> Section 2.2 Voting Rights.
