l.l.l "Articles of Incorporation," shall mean and refer io the Anicles of <br /> Incorporation of the Association as they may exist from time to time. <br /> 1.].2 "Assessment" shall mean and refer to those charges made 't, the association <br /> from time to time, against each Lot within the Property for the purposes, and �;ubject to the <br /> terms, set forth herein. <br /> 1.l.3 "Association" shall mean and refer to Crystal Creel: Homeovvilers Association, <br /> Inc. a Minnesota non-profit corporation, and its successors and assi(Fns. <br /> 1.1.4 "Board or"Board of Directors" shall mean and refer to the board of directors <br /> o:the Association, which is the governing bode of the Association. <br /> l.1.5 "By-Laws" shall mean and refer to the by-laws of the Association as they may <br /> exist from time to time. <br /> 1.1.6 "City"shall mean the City of Orono, Minnesota, a municipal col1)oration under <br /> the laws of the State of Minnesota. <br /> 1.1.7 "Common Expenses" shall mean and refer to all expenses la"vfitlly made or <br /> incurred by or on behalf of the Association in connection with the performance of any <br /> obligation or function of the Association hereunder or under the Articles of Incorporation or <br /> the Bylaws. <br /> 1.1.8 "County" shall mean and refer to Hennepin County, Krinesota. <br /> 1.1.9 "Crystal Creek." The property subject to this Declaration. <br /> 1.1.10 "Declarant" shall mean and refer to Kingsbridge Properties, Inc., and its <br /> successors and assirrts, if such successor or assign shall acquire more than one undeveloped <br /> Lot from the Declarant for the purpose of development of Crystal Creel: as a whole, as <br /> opposed to construction for sale of Dwellings on particular Lots. Notwithstanding the <br /> foregoing, no individual or entity acquiring a Lot from the Declarant shall become the <br /> Declarant solely by such acquisition, but only by a specific assignment and assumption of the <br /> rights and obligations of the Declarant hereunder, which assignment and assumption shall not <br /> be effective unless the instrument of conveyance expressly sets forth the same. In the event <br /> of such an assign.-nent, the assigning Declarant shall have no further obligat:_)ns to any Ov.-ner <br /> or the Association arising out of this Declaration. <br /> 1.1.11 "Declaration" shall mean and refer to this instrument, and all exhibits hereto, <br /> as the same may be amended from time to time, and filed for record in the office of the <br /> County Recorder and/or Registrar of Titles (whichever is appropriate). <br /> 1.1.12 "Dwelling" shall mean and refer to anv dwelling on a Lot intended for use as <br /> a single-family dwelling. <br /> BUSSED 509186.9 7 <br />
