RESTRICTIVE COVENANT FOR PROTECTION OF SEWAGE TREATMENT SITES KNOW ALL MEN BY THESE PRESENTS that (collectively, "Owners"), do hereby expressly covenant and agree to protect the approved sewage treatment sites on the real property in Hennepin County, Minnesota, legally described as Lot 8, Auditor's Subdivision No. 241, Hennepin County, Minnesota,per the following provisions: The property has two Orono-approved sewage treatment sites. To protect these important sites from inadvertent damage or destruction, Owners shall do the following: 1. Erect and maintain a clearly visible fence during construction twenty feet from the boundary of the approved primary and alternate sewage treatment sites along all parts of the property that are potentially accessible to vehicular traffic including cars,trucks, delivery vehicles,earth moving equipment,etc. Said fencing shall be in place prior to any earth-moving or construction activity on the site, and shall remain in place until completion of construction and final landscaping of the property. 2. After completion of construction, Owners shall maintain the alternate (future) sewage treatment site in an undisturbed manner,and not allow any excavation,filling,structures or vehicular traffic on the alternate site, in order that the alternate site be available for future use should it be needed. This Restrictive Covenant shall run with the land,shall be binding upon Owners,their respective heirs, successors and assigns, and may be terminated only upon written agreement of the City of Orono. The undersigned Owners have read,understood and hereby agree to the terms of this resolution and on behalf of the Owners and the Ownerss' heirs, successors and assigns,hereby agree to the recording of this covenant in the chain of title of the property.
