The City grants a variance to the 26' setback for certain grading and drainage <br /> improvements adjacent to a protected wetland within Lot 1, Block 1 of the Coffin <br /> property division based on the following findings: <br /> a. The proposed improvement would be consistent with the objectives of <br /> encouraging land uses compatible with the preservation of natural <br /> landforms, vegetation and the marshes and wetlands. <br /> b. The proposal does involve development of land and water areas essential <br /> to continue the temporary withholding of rapid runoff of surface water <br /> which would create downstream flooding or pollution. <br /> • 10. The City has.based preliminary approval of this plat on applicant's engineer and <br /> the City engineer's reports and findings conf'irmmg that drainage from this <br /> residential development will not intensify drainage/flooding of downstream areas. <br /> NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the <br /> findings noted above, the City Council of the City of Orono hereby approves the preliminary <br /> plat application of Tandem Properties and the Peter Andrea Company per plat drawings by Mark <br /> S. Gronberg, a licensed surveyor of Coffin & Gronberg, Inc. dated December 1, 1993, most <br /> revised date March 3, 1994, subject to the following conditions: <br /> .. 1. Countryside Drive shall be platted as a through road connecting to Old Crystal <br /> Bay Road. The roadway shall be dedicated on the plat. The developer shall grant <br /> easements over temporary cul-de-sac areas not located within 50' road right-of- <br /> way: Countryside Drive shall continue to be maintained by benefitting private <br /> property owners until road is approved for public maintenance and constructed <br /> as a through road. Cul-de-sac road within first phase of Coffin proper.ty <br /> subdivision shall be shown as an outlot and recognized as a private road. The <br /> City is to obtain underlying road and utility easements over outlot. The developer <br /> ' shall develop private covenants for the maintenance of private road and public <br /> � road to be maintained by private property owners. . <br /> • Page 3 of 9 <br /> .
