MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON SEPTEMBER 16, 1996 <br />• <br />( 99 - #2177 Bob Melamed - Continued) <br />Smith said, while some trees are saved, others are being lost, and the plan is somewhat <br />misleading since the lost trees have not been plotted. Melamed said there is less impact in <br />this revision. <br />Lindquist said the design is better than having a 20 -30' opening on the street side. <br />Melamed noted that he met with the original developer, Rebers, who was in favor of the <br />curved driveway in order to save trees and with approval from the Simonds. <br />Schroeder moved, Smith seconded, to approve Application #2177 for a variance with <br />respect to the driveway with the neighbor, Mr. Simonds, approving the setback in writing. <br />The developer and Staff are to determine, along with the City Engineer, whether the 6' <br />side setback can be improved upon. Vote: Ayes 6, Nays 0. <br />PLANNING COMMISSION COMMENTS <br />( #10) REPORT OF PLANNING COMMISSION REPRESENTATIVE <br />ATTENDING COUNCIL MEETING OF SEPTEMBER 9, 1996 <br />• Charles Schroeder attended the meeting. He had no comments regarding the meeting. <br />( #11) OTHER ISSUES FOR DISCUSSION <br />Hawn inquired about what course of action can be taken towards a property owner who <br />has disregarded conditions of a resolution. Mabusth reported that the individual in <br />question has been warned of the violation, which involves a safety issue, the building <br />inspector notified, and the City will issue a tag. <br />Schroeder asked for a discussion of the issue of structural versus non - structural. Gaffron <br />said he has studied the issue and written a report. He agrees that revisions are probably <br />needed to the code. The Planning Commission will view the report once Staff has <br />reviewed it. <br />( #12) PLANNING COMMISSION APPROVAL OF MINUTES OF THE AUGUST <br />19, 1996 MEETING <br />Hawn moved, Smith seconded, to approve the Minutes of the Planning Commission <br />Meeting of August 19, 1996. Vote: Ayes 5, Nays 0, Abstain 1, McMillan, who was not <br />in attendance. <br />18 <br />
