MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON SEPTEMBER 18, 1995 <br />( #13 - #2069 Cindy and Steve Harris - Continued) <br />Gaffron reported that the application was a request for a variance to construct a swimming <br />pool in what is technically the front yard of the property located between the road and <br />existing house. The code does not allow for such a structure in this area. The residence <br />and pool would be located in the center of a 25 acre parcel, 500' from the road, and <br />located in a 5 acre zoning district. <br />Gaf -ron said Staff would request an as -built survey once the pool was constructed as the <br />barn on the property is not shown on the current survey. <br />There were no public comments. <br />Lindquist moved, Smith seconded, to approve Application #2069 with the request for the <br />as-built survey upon completion of the pool. Ayes 6, Nays 0. <br />( #14) #2071 JAMES AND JOANN JUNDT, 1400 BRACKETTS POINT ROAD - <br />AMENDED VARIANCE - PUBLIC HEARING 11:09 -11:12 P.M. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />• Scott Crawford of Kraus Anderson Construction represented the applicants. <br />Gaffron reported a request to amend the prior approval for excavation in the 0 -75' zone to <br />rehabilitate a tunnel with retaining walls to the greenhouse. During the repair, it was <br />found to be in need of waterproofing, which would require the need to excavate and <br />remove an elm tree. This was not included in the plan previously submitted to the City. <br />The applicants agree to mitigate the loss of the elm tree. It was noted that the tree would <br />have been a detriment to the tunnel if left in place. Applicant noted 2 maples were <br />proposed to replace the elm. <br />There were no public comments. <br />Peterson moved, Schroeder seconded, to approve Application #2071 for excavation and <br />after -the -fact tree removal based on Staff conditions and with tree mitigation. Ayes 6, <br />Nays 0. <br />( #15) #2072 GRAYDON K. NEWMAN, JR.,1655 BOHN'S POINT ROAD - <br />VARIANCES /CONDITIONAL USE PERMIT - PUBLIC HEARING 11:12 -11:18 <br />P.M. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />The applicant was present with his landscape designer, Dale Gustafson. <br />24 <br />
