• <br />• <br />u <br />MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON SEPTEMBER 18, 1995 <br />( #5 - #2059 Minnehaha Creek Watershed District - Continued) <br />Pearce felt it would be to the City's interest to include conditions in the agreement <br />between Orono and the MCWD. A summary of these conditions were given out to the <br />Commission members. The conditions are intended to reduce the impact of the area and <br />be restorative of the area. Fontaine said there has been difficulty with the MCWD <br />complying with timely notice to Pearce with regards to revision of documents and follow <br />thru on design elements. He believes it is in the best interest of the City to require as part <br />of their review an artist's rendition of the area showing the revegetation, and explain the <br />differences between the specifications and what the MCWD is doing. Fontaine said it also <br />is necessary for the MCWD to spell out the maintenance requirements with who doing <br />what, who paying, and on what schedule. Specific recommendations were given in the <br />handout for such maintenance. <br />Schroeder commented that the project was complicated and asked Pearce what costs he <br />has born due to the project. Pearce indicated engineering costs have run $85,000, and the <br />easement will only recover about $20,000. Schroeder noted that the Barr engineering <br />report will have a positive influence on the project. It was also his belief that another <br />meeting is required for the Commission to look over the findings, especially in light of the <br />time and cost consideration Pearce has given to the project. <br />LaBounty said the project began in 1988. It was originally proposed to totally take place <br />in Medina, then was changed to two ponds in Long Lake, then changed to include the <br />Pearce pond and Deerhill, and now to include Long Lake, Medina, and Orono. The <br />phosphorus reduction amounts have remained the same. LaBounty pointed out if no <br />agreement can be acquired on the Deerhill Road pond, the project would be back to a 5- <br />acre pond on the Pearce property. <br />LaBounty asked, regarding the 7 engineering findings, that while 1 -5 met with the MCWD <br />approval, #6 LaBounty would like the agency to be treated as would any other federal <br />agency. On #7, the special conditions under which hauling can be stopped, LaBounty said <br />fines can be imposed on the contractor. He further noted no fertilizer would be used and <br />tree removal has been taken care of To control erosion, LaBounty said the slope down to <br />the pond would be 4:1 with a 6 :1 slope out of the pond. <br />Peterson moved, Schroeder seconded, to table the application. <br />Fontaine noted that LaBounty has only recently taken over the project for the MCWD and <br />has done a good job with communicating with Pearce. <br />Schroeder asked that copies be made of the Barr report for the Commissioners. <br />Smith thanked Mr. Pearce for his time and cost considerations he has taken. <br />14 <br />
