6 <br />PLANNING COD94ISSION MINUTES OF SEPTEMBER 16, 1974 <br />The application for Dr. M. M. Yokoyama, <br />2675 Shadywood Road, was tabled for lack <br />of an appearance to answer questions. <br />Samuel Marfield represented himself in a <br />variance to grade and remove trees within <br />the 751 lake setback area on a lot he <br />proposes to construct on in the newly <br />platted DiCon subdivision. <br />Adjacent neighbors, Mr. & Mrs. Levy, <br />appeared in opposition to setting any <br />precedent in allowing any variance to the <br />ordinance prohibiting this. On studying <br />the topographic map Mr. Marfield submitted <br />showing proposed changes, members felt there <br />would be a diversion of runoff now going <br />into an adjacent marsh to the lake. <br />Van Nest moved, Curtis seconded, that <br />because there was no hardship shown to <br />warrant a variance, denial be recommended. <br />Motion, Ayes ( 6) - Nays (0) . <br />James Dir-acles represented the Cheyenne <br />Land Company in obtaining approval for a, <br />preliminary plat. He said the company had <br />aow removed the objectionable long cul -de -sacs <br />and felt the plat as now presented should be <br />approved because: <br />1. It should be evaluated under the <br />present zoning, not the proposed. <br />2. That future Highway 1012 should not be <br />considered in the evaluation of this plat <br />because it is not on the five -year capitol <br />improvement plan for District 5 nor on the <br />10 -year improvement plan. He then stated <br />that in 1971 there were proposed three <br />alternatives for the highway, not all of <br />them going through the property and that <br />no firm commitment to use any one of them <br />has been arrived at.
