MINUTES OF A PUBLIC HEARING HELD JULY 29, 1974 Page 3 <br />His firm has registered engineers, and while JARVIS <br />tot hydrologists, as the Hickok firm, they do <br />study water retention. The water retention of <br />a swamp is estimated by the area, slope, depth <br />and the estimated 100 year rainfall duration. <br />Gilliard at this time stated that was 6" in <br />24 hours. Mr. Jarvis continued that: <br />1. DiCon is willing to abide with any conditions <br />if the plat approval was given. <br />2. They are not asking for dock approval at this <br />time and would abide by any regulations <br />placed by regulatory agencies. <br />3. Merely wanted to be given treatment that <br />would be common to other subdivisions. <br />Discission was commenced on riparian rights. <br />Paurus cautioned members not to grant anything PAURUS <br />to the developer that would set a precedent for <br />future development in the matter of transfer of <br />riparian rights and that lots adjacent to the <br />outlot should have no more rights than somebody <br />at the far end of the subdivision. <br />"t was here computed that there would be 19' of <br />- akeshore for each of the 17 lots if it were <br />equally divided. <br />Elliott opened discussion on the possibility ELLIOTT <br />of making the outlot public. <br />Van Nest moved, Hake seconded, to recommend <br />that the Council give preliminary approval <br />conditioned on the following conditions: <br />1. The lakeshore outlot common area be allowed <br />provided that it shall contain no boat launch- <br />ing, storage or dockage, nor shall it contain <br />any temporary or permanent structures and <br />ownership of membership shall be limited to <br />only the original 17 off -shore lots so that <br />any future additional subdivided lots would <br />be specifically excluded from ownership or <br />membership of the outlot. <br />2. Farview Avenue shall be rerouted so as to <br />avoid the low area located in the northwest <br />corner of the plat. The drainage from this <br />low area to the marsh along the lakeshore <br />shall be through natural drainage concourses <br />with proper storm water easements and designed <br />in such a way as to slow the runoff into the <br />marsh area. <br />3. All lots are to meet the minimum requirements <br />for the LR -lA district in all regards. <br />(Continued) <br />
