Ma 2/25/04 <br /> ACCESS EASEMENT AGREEMENT <br /> THIS EASEMENT AGREEMENT("Agreement") made this_day of <br /> , 2004,by and between Michael C. Fasching and Ellen I. Fasching, husband and <br /> wife("Fasching") and the City of Orono, a municipal corporation("City") . <br /> RECITALS <br /> (i) Fasching is the owner of the real property legally described on Exhibit A attached to this <br /> Agreement ("Fasching Property"). <br /> (ii) The Fasching Property is adjacent to Outlot A Tonkawa Shores Second Addition, <br /> Hennepin County, Minnesota("Outlot A"). <br /> (iii) Outlot A is a private road which provides access to the Fasching Property. <br /> (iv) Fasching desires to grant to the City an easement for ingress and egress over a portion of <br /> the Fasching Property for access to Outlot A. <br /> (v) Pursuant to the terms and conditions of this Agreement,Fasching has agreed to grant to <br /> the City, its successors and assigns,which assigns shall be limited to the United States <br /> Government, State of Minnesota,Hennepin County or lawful agencies thereof <br /> ("Permitted Assigns"), a permanent non-exclusive easement for ingress and egress <br /> ("Access Easement") over and across that part of the Fasching Property described on <br /> Exhibit B to this Agreement(the, "Access Easement Area"). <br />
